L1 to H4 to same L1?

Hi,

I was on L1 visa till Jan 2009 and is still valid till 2011. In Feb 2009, i got layoff and came to USA on H4 visa and so i have to resign from my current job which was on L1 visa in USA.

Now today my employer told me to join the company again on same L1 visa. he mentioned that he hasn't cancelled / invalidated my L1 status.

Issue/Question -

1. When i got a stamp for H4, my L1 visa stamp was in pasport was scratch with marker...

2. Since my L1 status as per my employer is still valid, can i join my company and do a change of status from H4 to L1 in USA?

3. do i need to go to India to do that?

Is COS possible because it is L-1 and not H-1? I thought that for a person to have L-1, the person must have been working in the foreign entity at the time of application, except for extensions?
