F1 overstay and taxes

Hi,
I have overstayed my F1 student visa for 8 months due to reasons beyond my control. I never wanted or planned to stay in the US illegally. It was purely accidental.

What should I do related to taxes? I want to pay them all, since money isn't a major problem (My parents sent me 2500$ every month last year).

Also, I have worked for one month using my student SS number. (bad Idea)

What problems may I have if I don't declare them?

My girlfriend and I plan to get married by the end of this year. We both agree that this may be a solution for the "accidental fact" which also involves her.

I want to regularize my situation soon, and be a proud tax payer.

That was an odd situation.

A group of students and I decided to participate in a protest against my ESL school due to some of it's policies. We decided not to take a test. The result: All of us got our I20's canceled.

What tax forms should I use? The F1 student form or a regular one?

Is it a big problem if I don't declare taxes? I want to do everything according the law (even though this is almost impossible).

You should file your taxes now and pay all back taxes, penalty (since it is after April 15) and interest. Depending on how long you have been in the US, you may be considered a Non-Resident or Resident (FOR TAX PURPOSE ONLY). If you only have worked for one month, chances are you won't owe anything and you will likely need 1040-EZ-NR or 1040A.

Look up "Volunteer Income Tax Assistance Program" in your area if you are not confident in filling out your form. See this link:

Also, beware of H&R Block or similar tax businesses. If you are consider non-resident for tax purpose, they don't see hardly anyone with that status and they could mess up your taxes. Remember, you are responsible for your tax return when you sign your name.
