Green Card through marriage

Hi,

I am a US citizen and my fiance is a canadian PR. We are planning on getting married and then applying for her US Green card through consular processing. she has a US tourist visa, is it advisable for her to come to NY for 4-5 days, get married here and return to canada and then file the I-130 or should we get married in Canada? Will it raise any suspicions is she came to US for 4-5 days, got married and went back. The reason we want to get married in the US is because you can get the marriage certificate in a matter of days whereas it takes over 2 months to get the certificate in Canada.

Please advise if this will raise any red flags in our processing.

Thanks much.
Nik

No, as long as the US immigration officers don't know she is going to get married. If they know that she is going to marry or even going to visit her fiance, they will suspect that she's going to stay in the US after marrying, even though you and her both know that she isn't going to do that.

So you may need a plan B. If she arrives at the port of entry and they don't ask anything about getting married or visiting a fiance, go ahead with the wedding as planned. But if they do ask her about getting married, she should say NO, and then postpone the wedding so she can avoid lying (they can catch such a lie later on, because they do take notes on the computer about what is said at the port of entry) and have the wedding in Canada instead.

No issues in entering the US with the intent to get married. Entering to get married and applying for AOS will raise red flags however. Since that is not your plan, you both should be ok.
