Hello,

I have applied for green card throu my mom who has been a permanent resident for the past 5 years. When i went for the first interview for my GC, they said that my mom has abandoned her GC. My mom travels back and forth between the US and back home. She only stayed one time for 9 months back home. Now, they rescheduled my appointment and asked me to bring my mom to the interview. Please answer the following questions:

1. My mom has a bank account, driver's license, phone under her name, YMCA membership card. will these things be enough to prove her ties with the US and that she doesnt want to abandone her GC?

2. Does the immigration have any idea of HOW LONG DOES A PERMENANT RESIDENT stay outside of the US other than asking the person him/herself upon entering to the US??

3. What are my chances of being approved?

Thanks

1.- No. She needs a home, mortage, lease, rent? she needs a job or something that shows income in the USA? and a whole lot more things... If you lived in the USA, wouldn't you have a house? car? job? etc.

2.- You bet your GC they do.

3.- Depends on the chances of your mom not losing her permanent residency.

she does not work, and she's been living with me in an apartment for the past 5 years.

I live in the US. My mom does too. I have been here for the past 7 years going to school. How can I win this case??

It doesn't matter how long you live in the US because you don't have a GC but trying to secure one through your mom. The USCIS will only look at your mom's GC to see if it's still valid and all the requirements has been met.

2. Of course they do, her passport has all the entry/exit stamps there. When go to the interview, they will look at your passport too, even the expired one.
