and out of status because of the stupid mistake and decisions other people have made so i never even showed up at school...now my question is its been like that since 2006sept so this year my country will not need visas to get in america because of friendly relations between our two countries.so my i94 is still valid and my question is i heard someone telling me that i can return to my country thru mexico and just come back to usa with my new passport and they will not know that i was here out of status? so can i do that?
 
Maybe or Maybe Not....it is a risk and may just be dependent on the customs agent at the border/airport and how much he checks your file when you arrive. If I were you, and you wanted to come back, I wouldn't go.

The fact that you are already illegal would pretty much bring your chances of using your country's VWP with the U.S. from little to no chance.
 
you are illegal, I-94 is DURATION of STATUS which means while you attend school (which you have not done). you would have to prove when you left the country (depends on immigration officer at border).
 
Another variable will be what (if at all) has the school entered into the SEVIS system since the prospective student never turned up.

Try it

if you want to get a risk take new initial I-20 from a school and it is recomended that you pay first smester fee in advance and go to canadian border or mexican border,usualy students have an edge then other visa holders while entering in USA, if i were u i would have take the risk because its really hard to live out of status, and breaking law is not good n one feel always a guilty and eventuly it effects on you personality.If you go out of country your visa will be outomaticly revalidated and you will be good.
