i am verry confused...please help me...what do i do next?

all...i am very confused and I dont know what to do...wht can i possibly do next?...i cannot even concentrate on work cos of this hanging around...here are the details:

1) I sent my n-400 form begining july 2008
2) Got my finger printing in 2 weeks
3) interview was scheduled on september 2008

i passed history and english test...i had one trip out of US in that lasted 11 months for which i gave enough evidence to show i did not intend to abondon my residence in US...the IO told me that I have passed the test, she made copies of my passport, ID, made me sign my photographs and said a decision will be made in 60 to 90 days..

90 days are over and i still havent heard from them...i dunno if my application is approved or not?...can i take them to the district court in 120 days because I havent recieved a decision yet...or I can inly sue USCIS if a decision has been made and oath has not come through?...I dont want to call and follow up because I am afreaid that USCIS will ask me to wait for another 60 to 90 days so i cannot sue them after 120 days now? m i making sense at all? pls help me:(
 
Keep calling the USCIS phone line till you get a IO (not the first representative), Give the IO your Alien number (or receipt number if s/he can not pull up your file) and insist on knowing the status of your N-400.

Do not worry about waiting another 60-90 days (I am not sure they can do it..) as that is not in your control. So just concentrate on getting the status.

Infopass is an option if you are willing to fight it out in person to get to an IO. Some times even with infopass you get the same message as from the USCIS website.

BOTTOMLINE talk to an IO.

thnks all of u for your responses...i have a question: weather i try go infopass route or meet the IO directly, will a decision be made right then or no?...do u guys think i can still sue them after 120 days even if they ask me to wait an additional 60 to 90 days?

also...when i go to website or on phone to track my application, it does not pull any information...it says to contact the local immigration office and tht is it...i find it strange but my lawyer says u can never track naturalization cases on website or by the automated phone service...is tht true?

They won't make a decision when you talk to an IO: the IO will provide you with a status update. The advantage of going for an Infopass is that you can request to speak with a supervisor who may be willing to take a further look at your case and render a decision.

Before thinking about suing them after 120 days after interview, you should document when you inquired and what their answer was.

When calling the 1-800 number, choose option 1-2-3, and tell the rep you applied for than 30 days ago and never received receipt notice. Don't tell rep anything else (like you had interview)..this will trigger rep to transfer your call to an IO who will be able to give you a status update over the phone.

This was one of the reason I was suggesting you use your Alien Number.

Some time back I had to get the status of my case but , I was given the standard answer from infopass and help line that is available on the USCIS website. After a month of banging head with the system, I called the USCIS helpline told them I do not have my receipt number (I lost receipt notice and do not remember the receipt number :-) ) only Alien number is avaialble. After a little ressistance the rep transferred my call to an IO and he pulled my file based on Alien number. He was able to give me current status based on that.

Now In my view while you are waiting for info pass (which may be weeks away) keep calling the help line. If you get any status good other wise you have infopass to fight on.

thanks very much Bobsmyth and vik_b...i will call them monday and also schedule an infopass...do u knw if i can specify request for a supervisor when i register for an infopass or do i request for a supervisor only once i m there?

Once you're at DO request to speak with a supervisor.
 
Bobsmyth since my interview is already done (only the decision is pending), is it safe to assume my name check is complete?
