Husband might go to jail. Will I have problems with getting my 10 years green card?

Hi!

My husband might go to jail for 3 years. I have my conditional green card. Will I have problems with getting the new 10 years green card? I am supposed to get it in 2010. I dont even know what to think. Any ideas?
 
You may need someone to submit a new I-864 for you, since your husband can not provide for you.

Other than that, you will have a harder time proving the relationship, specially if you are not living together.

I don't think any new I-864 is needed...she is ALREADY a permanent resident, only conditional.
Now, for your removal of conditions the problem is to demostrate that you are indeed still a marriage...if you plan to get divorce due to his "jail time" then you must be divorce and then apply your I-751 with the waiver.

If you plan to continue be marry to him, keep all the letters and jail visitations and things that you might want to keep in both names since he is not in jail yet unless some legal actions may avoid him to do so.
