I-485 Pending for Fiance

Hi,

My fiance came to the U.S about 5 years ago, with a special immigrant visa, his dad is a Pastor. They filed for an I-485, to adjust their status and their case is currently pending. I and my fiance have been wanting to get married, but are afraid this will affect the process of the petition. The last message we have recieved from USCIS was on november 2, 2008 saying:

We reopened this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS on August 29, 2008, and are now reviewing our earlier decision. We also mailed you a notice describing the next steps in the process. Please follow any instructions on this notice. Our review should be completed within 30 days. We will notify you by mail when we make a decision or if we need something from you. If you move while this case is pending, call customer service.

We've been waiting for their reply, but are stuck, we have made the deposit on our wedding venue, and are afraid we may lose it, we have the date set for the 29th of November. Is there anybody out there with an answer???

Can I get married without worrying about my fiance's and his families' residency approval?

Can you tell us what the right date is? If it has been more than 30 days, they could make an infopass appointment to try and get more info on the case.

Depending on how his family's case is being treated, your fiance may not be eligible for under his family's case once he gets married. For him, it would mean he is eligible to apply based on marriage (assuming your are a USC), but then there is still the case in the system that has his name on it that may make things messy. Also, how all this would affect the case for his family, i don't know.

From what you provide, the easiest scenario would be to wait until the pending case is adjudicated, assuming that will happen soon.

That is the correct date (September 2, 2008), but we've been waiting for a lot more than 30 days for any type of response. I am not a USC, I am a Permanent Resident and have been for over 16 years.
