Can someone help me please? actually it is for my dad!!

Hi,

I really love this forum and would like to thank all of those that share your experience first.

I really need your advice - any advice is appreciated here.

My dad's asylum case was approved in 2004, and he applied I-485 in 2005. I helped him to fill up the form. Now the USCIS send a letter and requre a interview - which is very rare for asylee applicants. I have several questions for this situation -
1 he used other person's passport to come here and already surrender his passport to INS when he applied for asylum. do we need to fill up Form I-601 Application for Waiver of Ground of Inadmissibility?

2 when he just came over here, he was arrested for shoplifting but then the case was dismissed. During this case and trial, he used the other person's name(on the passport). is this going to be a problem?

3 The lawyer want to charge us $3,000 to go with us to the local office, and that is why i decided to go with him without the lawyer. I guess,if we fail this interview, then i will have to take the blame.

4 on the I-485 application form that i help to fill out for him, i didn't check the box for that he was arrested before. because i thought the case was dismissed, therefore he wasn't convicted.

I am wondering if anyone has some advice for this interview?? Please help me!! I am really worried about this situation.

am wating for Interview date they transfaer me for Standard Interview

am not shoplifting , but i have Domastic Volince two time Aresst ,two time they dismissed
but it still show up and also i have 2 time dwi , i dont know what gona happen to mee ,am very conffused, i have my own bussines may be that can help,
i talk to my lawyer u know they want money all da time,
he said if u have aresst that why u going thru interview,
but am sure u be all right because he got only one time he can fill I 602 not 601,
he be ok as long he not owe anything to IRS

Mr. It is really a bit funny that your father is the one shoplifting and you are helping him; normally, it is the other way around. any way you are doing good job for helping your father.
As relates to your question, in most situations when an asylee applicant for greencard is called in for an interview, that does not mean that USCIS have negative information about the applicant. It means they just sellect some files and send them to the local office for an interview. About six months, one of my family members was called in for an interview. It was just formality. There are two scanerios for you father. the first situation is that all these issues may not come up and your father might be given the greencard without problem. the second situation is that the issues may come up. If this happens just explain your situation, and see what the officer have to say. Just be honest.
As far as the passport goes, most of asylees come here one fraudent way or another. Once your asylum is granted the passport problem goes away. It then cropps up in the greencard process. normally, the homeland security secratary waives the passport problem for the asylees. I don't know who does the paperwork. In any case, don't worry to much. Just go the interview. It will be easier than you think. Shoplifting is not a ground on which they will deny greencard...good luck
