H1 B Visa extension

Hi,

My H1 B visa is expiring next year January 23rd 2009. I will be going to India this month (October) for marriage. My company applied for extension (renewing for the remaining 2 years) last week and also they told it is not advisable to go to India while the extension is pending. They applied through regular process. If I need to apply for premium, I need to take care of paying the premium amount that seems to be huge amount.

My friends are saying that it's not a problem to go to India and come back before my current H1 B visa expires (on Jan-23-2009). I'm in a confused stage.

Also, after my marriage on Nov-10-2008 I need to bring my wife in H4 visa for that I need to get stamping in US embassey India before I return back to US on Nov-25-2008.

Questions -

- Is it possible to get H4 stamping during the month of November this year for my wife when my H1 B extension application is pending and my current H1 B visa expires on January-23-2009?? Will there be any question during US embassy interview?


- In case if I have to leave my wife in India and come back, will there be any question at port of entry, US about my H1 B expiry date??


Please reply as soon as possible since my dates are very short and also I need to plan for tickets, US embassy appointment and other things.

------------------------------Yes she can get H4 visa based on your visa stamp that is valid till January-23-2009. if you get your H1 extension approved while you are out then she can take H1 extension approval and get H4 based on that and when YOU enter US at Poe show your valid H1 visa AND H1 approval notice at POE so that you both get I-94 till your extension approval.

----------------------- why YOU will have problems as you will be having valid visa to enter?? if she gets H4 till January 23-2009 and does not enter US before January 23-2009 then she need to get H4 based on your H1 extension and need to get new H4 visa stamp.

**** best option is to upgrade your H1 ext with premium process and you may get H1 ext approved in 15-25 days. then your wife can get H4 based on H1 extension and you show valid visa stamp and H1 extension at POE
