He'll need to leave the US if he's out of status, and if he's subject to the re-entry bars, there's a problem.

I believe he's overstayed at least 180 days if not more. And if he can't get an h1b without leaving, I'd suggest that he not even try way.
Since he's married to a USC (based on a previous post) - he probably should file through his USC spouse and the overstay will be forgiven.
