I am currently in my 6th year H-1B Visa. My company for a green card on my behalf since filed since March 2003. I have an approved I140. The October 2008 prority dates for an EB3 category just changed to Jan 2005, so I am now eligible to file for an I485.

My question is can I file for the I485 on my own. There i a possibility that I can get laid off from my company upon expiration of the I485. Can I change employers and when is this possible so I do not lose legal status in the US. Please I need advise!

Since you have an approved I 140, you can file I485 on your own. No input from the company required for that. HOwever, you need to be working with them for 6 months after receipt of teh I485 application, before you can switch employers.

What do you mean "expiration" of the I-485? The I-485 is valid until approved or denied, however long that takes.

You can file the I-485 itself on your own, but (1) you need a job letter from the employer that sponsored your I-140 and (2) it is advisable to do a one-time consultation with an attorney to ensure you understood everything correctly and included all the documents that are relevant to your situation, before sending it to USCIS. Any mistake, misunderstanding, or missing document can result in delays or denial.
