B2 Marriage - previous marriage check

Does USCIS check with the foreign country to see if the applicant already married there? Has anyone had such experience? I am a USC and we are submitting I-130/I-485 to adjust status from B-2 based on our marriage. Our marriage is in good faith, however we had to register our marriage in my husband's country to please his family before he came to the US. Is it possible for USCIS to verify whether the applicant is already married in their native country?

Were you already married when you entered the US? Did you mention that on your DS-156? Or you were issued the visa before the marriage?

So, if you were issued the B2 visa before getting married, is that OK? Can he enter the US and file for AOS while on a B2 after getting married outside the US? (avoid the whole K1/K3 process).

I'm new here and have been reading these forums for about 6 months now and have been searching like crazy for an answer to this question. I am in a simular situation. I havent found an answer yet and figured this would be a good topic to chime into.

They were married when he entered the country on B2 visa. It is obvious that he misused the B2 visa to enter the country if he then tries to file for a GC.

I don't know why the OP and spouse did not follow the proper procedure and file for a spouse visa. There are a lot of potential problems here. It doesn't make sense to knowingly create problems by trying to get the GC from the B2 visa. It sounds like they may be planning to marry a second time for appearances.

IMO, he should return to his home country before the expiration of the I-94 and remain there until the spouse visa is approved.
