Need help please (pending I-589 and I-765)

Hello, this is my first time posting here...

I filed for asylum 9 month ago and my case is still pending with the court. Later, I filed a petition to change venue which was granted, but the clock has been stopped and it won’t be resumed till my individual hearing which is in the summer of 2009.

It said on the website that application for employment authorization will be only granted if 150 days have elapsed on the clock. I asked the court in writing to resume the clock but they told me they don’t use the clock for the purpose of employment and they are not going to do anything about it.

At USCIS Infopass I’ve been told that it doesn’t matter and I should just file the application within 150 days, but it seemed that they didn’t know exactly what they were talking about. I have filed for EAD anyway since my family members have been granted asylum and our cases are identical.

Will they deny the application?

Is there anything I can do to resume the clock or to get EAD?

I’m wondering if anybody here was in the same situation as me and what was the outcome. Any help will be very appreciated.

P.S: I have checked the status of the clock by dialing the automated system and entering my A# at 1-800-898-7180.
 
I have a family member in a same situation and she got denide for work permit. Does any body have any info how to start those clocks or how to get work permit. I try to deal this phone number but it is busy all the time...

sdghdfhfdjsdghs sorry to hear that your clock for work permit has been stopped. The clock will stop everytime you ask for a modification on the case. When you asked your case to be transferred, that stopped the clock. Now you have to wait until you get your initial hearing to get the clock running again. Sorry about this. Instead if you have had the case with the previous judge the clock would be still running. The new judge cannot put the clock running again.
 
Help for opt and asylum

This is my first post. I am an international student in maryland. I just graduated and filed my opt about two month ago. A month later i filed asylum too. But i ended up filing them in two service center. So my asylum application i-589 was returned to me saying that i was in court preceeding and i have to file my asylum case with office of immigration court who has jurisdiction over opt case. I never received any letter from the first service centers about court appearence. I only received the letter of action. My opt just got approved.. I now have my asylum application with me. Can anybody tell me what should i do.. Do i have to send it to the same service center that process my opt or send it to the other one..
Another problem is, vermount service center approved my opt. Now since i live in maryland i am supposed to file my case at texas service center but they have said they cannot process it.. So would it be a problem if i file my case at Vermount who approved my opt even though i dont reside in the state it belongs to.

The judge has the jurisdiction of your I-589 if the NTA was filed with the court. If USCIS or ICE issued you an NTA but was not filed with the court, then USCIS still has the jurisdiction over your I-589.

If you are not sure whether or not your NTA was filed with the court, then contact your local court and
ask them whether or not USCIS/ICE filed the NTA with the court.
 
The problem is i have never received any kind of Notice to Appear or NTAs. The only thing i did was filed my opt and its alreay approved. So, even if i am in a immigration proceeding that i am not aware of how can i check if i am in one. I thought that the texas service center returned my application because of my opt was filed at Vermount service center. I cant figure out exactly what are they saying.

You can find out by going to your local immigration court during business hours and ask the clerk. He/she should be able to tell you if the NTA was already filed with the court. If the NTA was not filed with the court, then USCIS retains the jurisdiction until the NTA is filed with the court.
