B1 visa for a wife of a permanent resident with a pending I-130

Dear all,

I petitioned for my wife's green card in Jan 2006. I am a permanent resident who currently live and work in Australia. I am wondering what chances would my wife have in getting a visitor visa so she can travel with me to the USA on my occasional visits. I travel to the USA 3 times a year and would like my wife to accompany me. Would the "intent to immigrate" still apply to her even though we both live in Australia? I have signed an agreement with my company to work in Australia for 3 years. would this help at all proving that my wife has no intent to immigrate because her husband will be in Australia for 3 years? we have twin baby girls, so we're pretty much settled in Australia until it's time to move back to the USA.

You can try. In general she is not eligible, but with your specific case you might be able to obtain a visa after all. Just give it a shot. There is no real downside, except for the fees.
 
I think you have bigger problems than getting her a visitor visa.

You are living and working in Australia? that sounds like "bye bye miss american... permanent residency".

You can not work and live in another country and maintain permanent residency, or at least apply for citizenship in 5 years... and specially that part about "living in Australia for 3 years" will work against you.

I am aware of the danger of living and working overseas as a permanent resident of the US. That's why I have an approved I-131 (re-entry permit) for 2 years and an approved N-470 (to preserve residence for naturalization). so I am covered. I am going to apply for citizenship next year.
