What will be the impact, if somebody files application
to revoke I140 before completing 180 days from filing
I485, but I140 revoked after 180 days from filing
I485?

Example:

1. I 140 approved.
2. I485 filed on 16h April 2008 (180 days complete on 16th Oct 2008)
3. On 16th Aug 2008, application to revoke I140 filed.
4. Employee left the company as soon as the 180 days over that is just after 16th Oct 2008 using AC21.
5. Now for example in Dec 2008, applied I140 revoke application processed and revoked I140.

What will happen to the I1485 of the employee who left the company?

--------------------------- if USCIS gets letter dated XYZ to revoke the I-140 then the USCIS will revoke the I-140 from XYZ date(not the date USCIS acts to revoke)
Example:

1. I 140 approved.
2. I485 filed on 16h April 2008 (180 days complete on 16th Oct 2008)

what is the date 140 was approved?
did you hit I-485 pending 180 days on 16th Aug 2008?, if YES then no problems

180 days complete by 16th Oct 2008 (see #2 above).

-----180 days complete by 16th Oct 2008 ????? it April 2008 now do you mean your I-485 pending will hit 180 days on 16th Oct 2008 ???
I 140 approved on 8th April 2008

* if your I-485 has not hit 180 days and the employer revokes I-140 you may be in problems.
Best option to leave I-485 hits 180 days and I-140 is Approved.

post full details:
I-140 Approval date..
I-485 Reciept date...
the date employer sent letter to revoke I-140

Hi Ginnu,

I am sorry if I mislead you and others.
I took the above mentioned example to understand the impact. Actually I am not in explained situation. I am just tryinng to understand.

Please find the example again for the sequence of events..
8th April 2008: 140 approved.
16h April 2008: I485 filed on (180 days are going to complete on 16th Oct 2008)
16th Aug 2008: Application to revoke I140 filed by employer.
1st Nov 2008: Employee left the company using AC21.
15th Dec 2008: Previously applied I140 revoke application processed and revoked I140.

Simply you do not get the GC because employer sent the revoking letter before 180 days.

you are not eligible for AC21 as employer sent letter to revoke I-140 before I-485 hit 180 days.
