L1A information for a manager

I have a business overseas and I want to get one of my x-manager to join our US branch office under L1A visa...the manager was employed by our overseas branch for over 3 years until 4 months back when he left the firm to join another company...my questions are:

1) i know my manager will be willing to join back my overseas branch if he is given the opportunity to transfer to our US brnach under L1A visa...if he rejoins our firm, is he still considered to have been employed by us for over a year?? Since he has technically left us 4 months back, does that interrupt his eligibilty for the L1A program?

2) since the line of business i want him for in US is new, should I setup a new company in US and apply for his L1A through the new comapny or shud I apply for his L1A through my existing US branch? I guess my question is, is there any advantage if I apply for his L1A through my existing company or regardless of how old the US branch is, it doesnt matter?

3) when will I be able to apply for his green card? I hear we can skip his labor approval process if he has L1A. Can I apply for his green card as soon as he gets L1A?

4) What is the typical time it takes from L1A to Green Card?

5) Is H1B in anyway better than L1A?

A1: He is fine. As long as he worked for the sponsoring firm for 1 year out of the last 3.
A2: I would stick with the existing US office
A3: No labour needed for L-1A applicants. You may apply as soon as he is in the US.
