L1 under process, can apply for H1?

hi there,

My spouse is in India, and L1 is under process with company A.
a) Is it safe for her to apply for H1-B through company B (in the US)?
b) If both L1 and H1-B petitions get approved, can she travel on L1 now and switch to H1-B at the end of year?
