Why don't you hire a lawyer for him?

Deportation, please help

Hi, I have been reading this website for so long, and only today decided to finally write something.
My story is: I came to US with my parents and brother in 1993, I was 11, brother was 8. We came from Estonia (me and my br were born there), but our mother is Russian, father is Armenian. Anyways, we left right after the Soviet Union break up, and Estonia regained its independence. in 1996 my parents filed for polytical asylum, and we went before judge in 1998 and got denied receiving voluntary deportation. We filed timely appeal, and in 2003 appeal was dismissed. Right within 30-days, my parents filed timely appeal with federal court and apparently our attorney did not send a brief when fed court asked for a brief within the briefing schedule (We did not know this). After federal court dismissed our case, since they did not receive any brief. (Again, our attorney never let us know. ) In 2004 I married a Permanent Resident, and in June 2007 he became US citizen. We have an 18 month old daugher now. My husband just filed I-130, and it was transferred from Vermont to the local Federal Plaza Office . (Most of my attorneys say, if i go to that interview I will probably be detained there). Anyways my brother had a court hearing regrading a drug violation, the case was dismissed but right after court hearing he got picked up by ICE. This is his 3 month right now, and he is in LOuisiana Jail. They will try to deport him to Estonia but we are not citizens of estonia, and we don't have any pasport from any country, parents even though are Russian and Armenian are not citizens of their country either. So most likely my brother will be released after 90-day. However, in my case is there anything i can do to stop my deportation proceeding?. Or Should my husband just withraw from I-130, becasue I don't want to be detained and leave my baby behind.

I dont think you will have to leave the country because your husband and your baby are US citizen. My advise to you is get a good lawyer and go to that interview. It should be fine.
For those of you who are seperated from your family because of the backlog in Visa please go to this web site http://www.americanfamiliesunited.com .
This is a group of people who are trying to push for legistratvie change to eliminate Visa backlog. Also please sign their online petition if you agree with their cause. You can also make a donation for their congress lobbying effort if you can afford.

If he is not in expedited removal, then local authorites have the discretion to grant bail. Whether they will do it is a different story. I do not know about the practices in Texas.

Do not go to the interview at this time. They do have a history of detaining people with final deportation orders who show up for interviews.

Hire an attorney to void the deportation order first.

Does anyone know what ways are there to void the deportation? Because I do have a lawyer, and she says all i need to do is file motion to reopen, but the time for motion to reopen expired 5 years ago already. Is there like cancellation of removal, or stay of removal, what are the correct terms and procedures? Thank you guys.
