Arrests and cetizenship!

I have been arrested twice:
1- in September 2000 for overstaying (immigration charges) i was detained by the INS before i received the asylum.

2- In December 2004 i was arrested for traffic violation ( driver license was suspended and i didn't know, i was only taken to the station for 15 minuted then i was released. Later i reinstated my license and got a deposition, i even enclosed the deposition letter when applied for my I-485 which was approved on June 11/07.
B.T.W the license was suspended only for not having insurance 2 times.
Do you guys think that would be a problem when applying for citizenship on March 09?

I'm not sure about #1 - but #2 isn't a misdemeanor or a felony charge and I don't think that was an "arrest" - of course, I'm in california and those are our state laws.... yours could be different. Check that out and/or call the local police station in your area and find out. Or contact an attorney.

If you got your GC with all of that..you are ok. But make you remember the facts in case you are asked.
 
asylee, first of all, be responsible and accountable person. you got to obey the laws cos you know many crimes are deportable crimes. so respect the laws and rules all your life anytime anywhere!

in terms of arrests, it doesn't matter much as long as you are not convicted of the charges in court. but still, having multiple arrests and criminal charges in your record are problem for immigrants in the country regardless even no convictions.

your arrests don't seem too bad, but next time, respect laws and carry auto insurance cos you don't want to kill someone on road and not be able to pay for the victim's care and compensations. you will be in much bigger problem then.

Thank you for you advise, believe it or not i'm a responsible person, at the time i couldn't afford to have one (being asylee) and that was back a few years ago, now i carry insurance on 3 vehicles.
I hope this is not going to be a beginning to be bashed by the forum members over insurance issue! any more thoughts?

Hi, Asylee01,

I have one question, How come you will be aplly for citizenship on March 09 if you got approved at July/2007 ? Aren't You suppose apply for the citizenship at May/2011 based on 4 Years 9 months from date at you GC.

NO, based on 3 years (married to a USC) plus one year back date.
 
To be granted citizenship you have to demostrate that you are of good character and moral in the last 3/5 years (no crimes or arrests). You fail that, and your application may be denied. Talk to a competent lawyer about your specific case.

Make sure you have been married to and living with the same US citizen spouse for the past three years. Also, your spouse has to have been a US citizen for the past three years prior to you applying. Also, I would definitely disclose the two arrests on your N-400 (I know this was not your questions but I would make sure you disclose all those anyway).

YOU FAILED TO DEMOSTRATE GOOD CHARACTER AND MORAL BY BEING ARRESTED. The arrest is in your record; therefore, you will be questioned about this issue in your interview and IT MAY be a cause of denial... IT MAY... so talk to a lawyer so whne you apply you send all the documents about this arrest.

BTW: People get their US Citizenship application if they have not demostrated good character and moral, which an arrest will break that. I see it every month in the organization I work.

I am not going to argue but here is what happened:
it was Christmas and was taking the family to see the lights, i had to go thru " private military road" NOT a state road, i was 5 miles over the speed limit which i really was going with the traffic flow, i got pulled over and when he checked the license he found out that it was suspended but i never knew that it was because i never ever received any notice of suspension. He took me to the military police station and they finger printed and released in 15 minutes, i was told by the officer in charge there that when i get the license re-instated and pay the ticket i will be issued a disposition, so i did that and everything was taken care of as i was told, the only thing is that i couldn't drive on the military base for 6 months " like i really wanted to!"
I don't really think it's that serious as it sounds for the fact that i mentioned it on my I-485 and sent that disposition letter issued by the military " Federal Judge".
During that time i had to drive with a form called " SR-22" for the whole year and everything is back to normal, always paid my my tickets and i always carry insurance on 3 vehicles, no crimes or felonies ever been committed neither planning on it.

Sorry it's out of scope of this thread, but I have a question about SR-22.
I got rear-ended at the end of last year and DMV reminded me of filing SR-1(accident report), so I did file it. I received a letter from DMV this week, telling me that they received SR-1, however, the proof of insurance at the time of accident is not received( I was insured). DMV is asking SR-22 as proof of financial responsibility. How did you get SR-22 ? I talked to insurance agent and they said SR-22 is not something to send to customer. Which state are you in ?

Texas here, i got mine from the insurance company.
I don't know why you would have to carry one if it wasn't your fault and you had a valid insurance at the time of the accident?!!

California DMV wanted to verify that I was insured when I had accidents. Somehow, my insurance info seems missing in their system, so they sent me the order of license suspension and I need SR-22 to cancel suspension order by probing I was insured at the time of accident.
Thanks for your repply, I'll talk to insurance company again.
