Family filed for PR 7 years ago

Hello,

My friend is on OPT right now but time is running out. She came as an F-1 seven years ago. A short time after, her parents filed for PR and had included her and her brother in their application. They were both under 21 at the time. The parents' application is still pending and she is worried that she will be out of status soon.

Also someone mentioned that she had since aged so would no longer qualify for PR under her parents. I thought that USCIS could lock in her age at the the time her parents applied for PR and included her.

Can anyone shed some light on this process? Do you think my friend can still receive her PR status?

I'm not sure what category but she mentioned that her grandmother had sponsored her dad a long time ago but he gave up his GC. So this application is a reapplication for his GC and he included his wife and kids (who are my friend and her brother).

Doesn't sound too promising - after all, its not like a current LPR or USC relative is petitioning an I-130 for her. If that were true, the rules of CSPA would come into effect.

Reapplication for old GC sounds like someone trying to get a Returning Resident (SB-1) visa.

If I were in this lady's position, I think I'd be trying to find a way for employer sponsored GC or H1 visa.
