Help: want to change job after filing I485 180 days

My I485 was filed in last december(RD: 12/22/2006). The company is suffering from loss of market. I am afraid it will start laying off some people soon. So, I am considering find a new employer.

My concern is that my LC was filed in the title of "filed application engineer". The SOC code is 15-1031 and the Occ title is "software engineer , applications". Job description is " Support customer design efforts for video processing and editing and compression, including working with customer to validate design, verify schematics and develop software for customer's application" . But, I have been changed to firmware group for three years after that. I want to find a new job of firmware engineer position. But, I don't know if it belong to the "same or similar occupational category" . For example the following one:

"1> Develop network equipment embedded software with a MPEG Digital Video Application focus - 2> Specify, design, implement and test - packet and video based software; 3> Integrate and Debug new SW on sophisticated multi-processor communication system (VSP - and other products); 4> Follow Design Process for compliance w/ Motorola Development standards; 5> Study Functional and other specifications and participate in planning activities by providing decompositions and scheduling estimates; 6. Provide accurate status and progress against plans, there by actively participating in the successful mgmt of a project. ^^

- you can change employer if I-140 is approved and I-485 is pending more than 180 days (better join new employer with H1 transfer if you still are on H1 status)
to invoke AC21 with pending I-485 you need letter from new employer with same/similar job duties as on your LC that are:" Support customer design efforts for video processing and editing and compression, including working with customer to validate design, verify schematics and develop software for customer's application" .

My i140 already got approved.

I used my AP already. But I returned to my sponsoring emplyer. Some people said that I am still in H1b as long as I stay with the current company. Could I do H1 transfer to another company?

--------------YES, talk to new employer lawyer and dont say you have EAD in hand
