Hello,
I am from india and a company applied for my h1b visa in april07 and in jul07 the uscis came back with a query to send an offer letter signed by me. The company started imposing newterms and conditions (like reduced pay than what was negotiated before etc..) and so I did not send a signed offer letter. The online status of the application says that a decision has been mailed (to that company). The application must have got canceled. Now, my current employer would like to apply for my L visa and i am required to show the decision letter that USCIS sent to that company.
As you can guess, that company is not willing to give that letter and is asking me to reimburse their h1b expenses (50% was paid by me) first. What are my options here? Are they legally obligated to hand over that document to me? If not, it sounds like this is a tool that can be used by companies to wreak vengeance on employees who have quit them.
Any suggestions/ideas to get me out of this mess will be highly appreciated.
