this question is for my friend.

she has been here in US about 5 years already and for some reason her case took forever and ever to process. she filed AOS in 2002 and just had her interview last year. she got 10 years card.

as far as i know, you can apply for citizenship 3 years after you got that 10 years card right? is there any chance that she can apply for citizenship now since she's been here so long OR they will consider just from the date you recieve the card?

2 years and 9 months from the date "resident since" on her GC, if she is still married to a USC and has been married to him for these 3 years.
 
thank you. thats what i told her too but she doesnt believe me..she still got all those forms and wants to file..
 
Follow up question...does that apply as well to conditional GC? Or is it 2 years and 9 months AFTER the conditions are removed?
 
i got my conditional green card this year..that means i can apply for the citizenship on 2010 but that should be after i filed for removing the condition. is that correct?

Let's set an scenario.

You married an US Citizen. Been married less than 2 years and Filed for AOS (I-130, I-485, etc)

You became a Conditional Resident in July 2007.

Then you file to remove conditions (I-751) 90 days before 2 years after being a Conditional Resident. Probably in the mid of April 2009. Then you will get a letter telling you that your resident status is extended for 1 year while a decision is made.

Once 2 years and 9 months since you first were awarded Conditional Residency. Around April 2010. If you are still married to that USC, You file N-400. To become an US Citizen yourself. (Even if your I-751 has not been approved yet!).

well, how about you point her to the USCIS page, show her the Citizenship section, and then she can read the Guide to Citizenship, and then she will believe you. Otherwise, she will waste her money and you will be able to tell her "I told you so".
 
I read the form N-400 last night and its just stated that you must be lawful permanent resident at least 3 years so I was not sure if it means aftefr 10 years card or not..but hahahaha I totally understand it now...
