B1 to H1 - Urgent help needed!! Please Help me

Hi,

I applied for H1b from other employerA and got approval, But still I didn't go for stamping in India. Mean while employerB (my current company) asked me to travel US on B1 Visa on urgent basis. I got my B1 Visa stamped and came to US 1 week before. My I-94 is valid until mid of november'07. Can I stay here and start working by shifting to Employer A from 01-Oct (since my H1 is valid from 01-Oct) without leaving to india?. Is it legal to work in this case?

Please suggest me in this issue. Your help is very much appreciated.

Hi,

-----------------it seems US employer A filed H1 for you and that was approved and A sent you H1 approval notice and you are in India . you did not provide info if you got H1 visa stamp based on A H1 approval or not

-------------------you did not enter US on H1 and your I-94 is not based on H1 status how you can work on H1 status?
Is it legal to work in this case?
if you want to work on H1 status in US then enter US on H1 status

you need to go out and enter on H1 status if you want to work on H1 status
