H1B expires in a week: ok to enter US?

Hi All,

Funny situation:

1) I am out of the country right now - my H1B expires end of next month (Sept 30th)

2) Need to travel into the US right on Sept 24th

3) Cant apply for H1B extension (non-consular) as I dont have an I-94.

Is it ok to travel on Sept 24th (close to the expiry date) and then have my employers apply the next day?

Please advise.

-------------------your H1 expires on September 30 if you enter on 24 will you be able to file H1 extension? I think 29 and 30 are Saturday/sunday it means your H1 extension Must reach USCIS before I-94 expiry date. if your lawyer keep all the papers ready like LCA+ form I-129 that is signed by employer then lawyer only need to attach the Copy of your Latest I-94(front and back) and can mail it on 25th

------------------if you have H1 approval notice you can apply H1 visa stamp with US consulate. one gets I-94 when enter US or when you file H1 while you are in US or file H1 transfer while in US, H1 extension or H1 transfer approval notice will have I-94 attached if you have been on valid status in US (not out of status)
