I was on OPT until July 9th 2007 then I got my I-20 which is valid beyond oct 1st 2007. The current I94# is for example 123456789. This I94 was issued to me when i arrived in USA in 2003.

I got my H1 and change of status approved on Aug 6th 2007. The I797 has a attached I94 but the number on the I94 is 123456789. The class on the I94 is H1B which starts from oct 1st 2007 to oct 1st 2010.

Is the I94 correct ? Please advice.

Thank you

I 94 with no departure date and incorrect class

I arrived USA ( MKE) on 21sy Jul 2008 and my POE was Chicago... i was just checking my passport and i realised that the CBP officer has not given any departure date information on my I94.
In I94 there are two fileds CLASS ____/ Untill _____ , In class its says C1 and UNTILL is BLANK.
I have a valid B1 Visa with multiple entry for 10 yrs.

Please help me in determining validity of my I94 and if any info is not rite on it.

Thanks for the guidance.

1 If you came on B1 visa then on I-94 the CLASS should be B1 and UNTILL should be 6 months or less than that they write the date. your 10 year Visa stamp does not mean that you can stay 10 years in US
2 if your POE was Chicago then You should visit CBP Deferred Inspection

Chicago, Illinois –60605

Time: Monday to Friday 7-30 to 16.00
Phone:312-834-0908

go to the above address and they may ask any evidence that you Cameto US on 21sy Jul 2008. Take any evidence with you and they will correct the
I-94 .
** post the info after you visit Deferred Inspection

H1B and F1 issue

I am a student on F1 visa. I recently signed a contract with a consultancy which filed for my H1B. I was told that I was approved and they also gave me copy of approval notice. They asked me for a deposit of 1200 dollars, I paid, which was going to be returned when I get a job through them.

Now on the basis of "lack of commitment" they are terminating my contract, canceling my H1B and asking me to pay another 2000 dollars for the fee. They are not returning that initial 1200 dollars deposit. Is this legal?

I was never told that I will be paying this additional 2000 dollars. It was never given to me in writing? So what should I do in this case?

Also, being "approved for H1B" does it mean that my F1 student visa is still valid, because I am planning on going to school again if I don't get a H1B sponsor. What should I do if F1 is not valid?

Any help is appreciated.

----------------------------it all depends on contract you signed with them but for filing H1 for you and charging fee from you is not legal. why you did not post before you gave the money to them??

-----------dont pay them. it is illegal. do you have any evidence that they are asking 2000$ or you paid them 1200USD???I was never told that I will be paying this additional 2000 dollars. It was never given to me in writing? So what should I do in this case?

Hi,
I came to US in 2008 on my H4 and went to India in 2010 for couple of months and I got a new I-94 at the port of entry while coming to the US. After that I had to apply for my change of status from H4 to H1. And that has been applied with the old H4 I94 number. I am now applying for my H1 transfer and was wondering if I will have any issues with the transfer, or while applying my GC or when I travel? Appreciate your suggestions Thanks.

As long as you did not violated H-1B status meaning you got paid all the time while on H-1B status, I dont think you would face any issues while transferring to new H-1B employer or when filing I-140/485
