Urgent problem Please help (I-131) return to USA

Hi Im having a big problem, Im cuban i was in the USA
until June 13 present year when i have to leave because of a
big emergency to argentina, where my family is living actually.
I was living legally in the Usa with an I-94 (cuban parole)form wich i got
after crossing the Mexico-USA border on April 2nd 2007. I didnt know about a
travel document required to return to the usa. I received my social
security number and EAD and i was waiting for the year required
to apply for the GC. Now some people tell me tha i need to apply
for a travel document or advance parole (I-131) and other tells me that
i wont be able to return to the USA. I still have with me
the I-94 form wich is good until april 2008 when im suposed to
apply for a residence.
How can I proceed in order to go back to USA? Would I be able
to return? should I ask for a visa?

Hay, as long as you have an I-94 stamp stated active till April 2008 it is same thing as, I don't know if you heard about this, in some cases immigration officers issue a stamp as I551 on I-94 till they get thier actual Green card. My freind from Tanzania, he has same type of case.... Do not worry just show at the airport the I-94 and if they asked you for additional things show Social security and work permit....

Yes, you do need advance parole. You cannot return to the US without it. Contact the nearest US Embassy/consulate in Argentina immediately.

well, i already contacted the nearest consulate and they told me to return the I-94. they have no idea about this forms.. should i go personally in that case?
now the question is, in case that i need the advanced parole, can i apply for it outside the usa?

hay, You do not need all that, just come back show to immigration officer your I-94 is good for another year.
 
Argentina Immigration Officers won't let travel to US without these documents: green card, us passport, advance parole, or visa.

Hi, I called to the USCIS and an specialist told me that I cannot return to the USA due to that I abandoned the process without getting the residence or a rentry permit or travel document.. seems that I cant go back..
is there any other chance??

Apply for a travel document (form i-131) with evidence you have(parole letter) etc. In the form, pick the option to send it to consulate overseas and see what happens.
 
Yeah thanks, thats what Im thinking of, but the difference is that 2 months ago the price for the application was 170 and now its more than 300.. ill be sorry if i waist such amount of money without gaining anything.. this is a very hard situation and the bad thing is that they cannot understand that it was an emergency..
is there anyone in the same case or what are the chances to get it??

Form I-131 can only be approved if filed by someone present in the U.S. If you are not present in the U.S, contact the nearest Embassy or USCIS office having jurisdiction over your current location to see if you can file for a Travel Document. Usually it will be considered by CIS if you've not been absent for more than six months. You have to proof to them that you did not know of the requirement to obtain a Travel Document before your departure.
 
well, I didnt know at all about this requirement, you can see it on my first post.. I called to the USCIS this morning and they told me I cannot go back.. I called also the embassy here in buenos aires and they told me they dont know anything about this situation and they sent me a letter saying that i should return the I94 form, I just get responses from argentinians but i havent talked to an american yet, and I think argentinians working in the embassy are not informed about the steeps or so..
i just dont know what to do and i had to get a job to survive here.. i had all my expectations based on usa and just had to travel because of an emergency
 
As far as I know you should have applied for RTD or advance parol while you were in the US. You could have asked them to send it to the consular in Argentina, meaning you didn't have to wait for it here before you went. Your only option it to get a lawyer that will help you. Also try to apply for RTD and have it sent to the Argentina. Even if it's expensive, it's probably your only chance.

Although refugees and asylees who depart the US without a valid travel document are not entitled to readmission, their status as an asylee or refugee clearly indicates that there are compelling circumstances to consider in evaluating their application for admission. Therefore, INS offices overseas have been instructed to issue travel documents to those who left the US without knowing the requirement, and apply for the document within one year of leaving the US. If the person fails to obtain such a document, they may seek humanitarian parole into the US. While reentering on parole terminates the person’s status as an asylee or refugee, the person is still eligible to apply for adjustment of status as a refugee or asylee.

Im about to apply for the travel document.. I will be sending the application next week as if im overseas but with the USA address and the receiving address also in USA (a friend of mine will receive everything there, i just dont trust international mail).. If obtaining such document fails, how can I obtain humanitarian parole into the USA.. Another thing, I wrote to the embassy in Argentina and they dont know anything about these cases..and the only time I called USCIS the specialist told me i cannot return to USA.. Im also applying for argentian citizenship and next year (i have i-94 valid until april 8th) argentinians wont need visa to enter usa, would it be a good idea to enter usa this way...
I dont usually have time to take care of these case, not because its not important, its one of my priorities, but I had to get a job to help my sister here and support myself, and as i work in informatics I have a lot of work and responsabilities and I think its worthless to get in touch with the american embassy in argentina...

sometimes i look at the documents (i-94, employment authorization card, SSN) and just think about everything I went through to get those (mexico frontier, family issues, LOOOT of saved money) and now its almost useless just because for the simple fact of leaving for an emergency without knowing the requirements...

WOW.....thats Fraud...you should be ashamed of your self....people like you give us a very bad name......and stop that bull about you did not knowing the requirements to enter back the usa... what did you think people use to enter back?? the bus card .........maybe !!!!!!

dude.. i have nothing against you in person .....BUt there is the LAW and we have to do everything according to it......
do you know that getting another country citizenship means you dont care about your asylum case in the us anymore and the USCIS may cancel your asylum ??
and by saying that your are still here in the us to get the RTD to your us address is a crime...?
