Confusing Situation (Need Help/Advice)

Hi All,

We are a company out in the Midwestern US, and we are looking to sponsor an individual for our IT Department, unfortunately he is nearing his six year limit on H-1B on October. He has talked to our corporate counsel with the revelation that he was on H-1B since October 2001 but his previous employer did not find him any positions, using his terms he was benched without pay. Will he have any problems going thru the whole process of extension and to the green card? This will be our first sponsorship as a company.

when did he LAST time enter US
what is validity of His I-94
if he was on bench BEFORE his LATEST entry to US and has latest2-3 pay stubs and valid I-94 then you can file his H1 extension BEFORE his /her I-94 expires (petition must reach USCIS BEFORE I-94 gets expired) for more info talk to your lawyer
