Hello all,
I am completely new to the green card process, I am trying to do some reading and catch up. I have approved labor certficate and I-140. and now since the status is current I plan to apply for 485. I am also filing for my wife with me she is on H4 visa right now.
One question i have is does everyone have to get police clearance? my wife just came from india do I need to get a police clearance for her from india.
I have been in US for last 6 years now, will I need police clearance for india or US ?
Thanks In advance

You would not need to get any clearance from police in India to file your 485. You can just go ahead and file 485 for you and your wife since you have approved 140. FBI will do all that clearance thing for you...

Thanks DBEC_Labor_pain.

Will I need to file G325A for both me and my wife?
Also I will have to get the medical tets done before the filing right ? How long does it take them to give you the tests back?

Thanks again

Thanks DBEC_Labor_pain.

-----YES, you have to fill YOUR G325A and sign it and your wife has to sign her G325A
Also I will have to get the medical tets done before the filing right ?
----YES, for you and for your wife
How long does it take them to give you the tests back?
---depends on doctor office
Thanks again
file the I-485 with all the "initial evidence." send I-485 with all the required documents.
Read below:

From Matthew Oh, Attorney at Law

06/17/2007: Flexible RFE/NOID Response Rule and Advisory for July EB-485 Filing

As we advised earlier, the USCIS published a new rule that allows the USCIS to have more discredtion and control over the two issues: One is shortening of the timeframe for responses to RFE from previous 12 weeks to any period of time which they see fit. The second rule is their authority to either reject or deny petitions or applications without issuing RFE where "initial evidence" is missing in the filing. Previously, the so-called Yates memo indirectly required the agency to avoid rejection and denial with a recommend to issue RFEs as much as possible. This part of the Yates memo is overridden by the new rule who took effect yesterday, June 16, 2007. It is thus likely that the Service Centers will more aggressively reject or deny the I-485 applications where the "initial evidence" are missing in the filing packet. It is thus very important that people understand the definition of "initial evidence." The initial evidence varies between the nonimmigrant and immigrant proceedings and for that matter, each type of proceedings. The immigration regulation lists in details the initial evidence. However, the instructions sheets to each petition or application lists the initial evidence that are required for filing. Accordingly, beginning from today, people may want to read the instruction sheet for I-485 form carefully to learn the list of initial evidence and not to miss omitting these evidence in filing I-485 applications.
One of the initial evidence which is listed is the sealed I-693, the Medical Examination results completed and sealed by the USCIS designated civil surgeons who examined the applicants per the immigration rules. As we reported yesterday, attorneys asked the USCIS authorities to accept I-485 applications without the medical result, but their answer was that they were taking it under advicement but as it stands now, the sealed medical report would be required as initial evidence, accoring to the USCIS authorities who were present at the AILA Annual Conference in Orlando. We understand that in some areas, there are a huge backlog in the physician's clinics for such medical examination. However, people can shop around the authorized physicians in much broader areas. For instance, people usually were asked to schedule such medical examination in the local "district" office where the applicants resided. The definition of "district office" has been broaden lately. Former district offices have been turned into field offices of a district office. Accordingly, people can schedule the medical examination through a physician located outside of their residence if the area falls under the jurisdiction of "district" even if it is outside the jurisdiction of "field office."

So from the reading of 485 and section Initial evdidence, this is the list I made correct me if I have missed anything.
1.) Birth Certificate (me and wife) (should be translated in english if not in english)
2.) Copies of entire passport (me and wife)
3.) 2 photographs (I dont know what is A number, I am on H1 b and wife on H4)
4.) Biometric services - ( finger printing will be done after i get a notice from USCIS right?)
5.)Police clearance- not needed I have approved I 140
6.) Medical examination- I am scheduling an appointment for me and my wife.
7.)G 325A - Will have to submit for me and my wife.
8.)Affidvait of support - I-864 will have to submit this form for my wife.
9.) Letter of employment from my employer - have approved I 140
10.) Evidence of eligibility - I am guessing submitting DOL Labor certification and I-140 is what I should submit.

Does this look good ?

Thanks ginnu,
I dont know actually what is biometric services, I searched that on internet and it cam back saying fingerprinting ...and then reading all the forums I see that you have to get letter from USCIS to go for finger printing....thats what is my understanding.

Can you explain me what is Biometric servcies, and if we need it while applying 485 what is the document I should provide.

Which forms do you need for EAD and AP?

Thanks again

------------------------ you dont need to provide anything for Biometric servcies. at the time of I-485 filing you pay the Fingerprinting fee and USCIS will send FP notice and you go for FP
Which forms do you need for EAD and AP?
-------------------------------for EAD I-765, for AP I-131

You do not need to do anything with bio to apply for 485. You will need to wait till you receive the letter from USCIS to get your bio done. Once your bio is complete, results will be sent to FBI for your background/name check. They will schedule the date and time for the bio appt and send you a letter once the initial screening of your 485 is complete. Hope this helps.
AP - I131
EAD - I765
