I-539 TD extension approved

My wife had to leave for Canada a week ago before receiving the i-539 extension approval. Now the extension has arrived in our US address. Does she need to apply for a new visa at the Toronto consulate since her old one expired, or is this extension enough when she returns?

The need for the consular visa depends on her country of citizenship. If she needs one and does not have a valid US visa now, she needs to get one.

If she does not need one (if she is cdn), then Fedex her the new I-94 that you have received so that she will use it to enter the United States.

Because of AVR, aut visa revalidation, she can return on her expired consular stamp. She will still need the I-539 renewal to show that she remained in status.

Thank you BigBoy and Nelsona. First of all, she is not CDN. Is she still required to go the consulate? What is AVR?

If she is not cdn, (as Nelson says) she might be able to use the AVR and eliminate the need for a consular visa.

AVR -> Automatic Visa Revalidation. Google it.

I'hv questions abut my wife's TD extension. she is not cdn citizen, and I'm going to apply via mail (form I-539). please tell me what type of supporting documents I need to send USCIS. should I send her original passport to stamp new visa ?

she need to send proof of identity, proof of marriage and proof of your TN (I-94). She will not get a visa stamp, and should NOT send her original passport, but a copy.

If she leaves US (except for short visit to canada/Mexico), she will need to get visa stamp at a consulate.

The I-539 and visa stamping are separate processes.
