I am on H1B and on 8th year extension; the latest and 8th year extension expires on Feb 25, 2008.
I have decided to relocate to Norway for a temporary assignment for 18 months working for the same company. I came to Norway in March 12, 2007 and started working here. I am in US payroll and my salary and other benefits are still paid in US and still a US employee in all sense other than just physically sitting here in Oslo, Norway. My US Company has sent a letter to the Norwegian social security regarding this arrangement so that I am exempt from Norwegian tax.
Before boarding from US to Norway I came to know from my company attorney that my Labor processing got denied by DOL (No further communication from DOL on the reasons on rejection even after 3 months as per my attorney). Also the attorney mentioned that I am not in valid status right now, is this correct?.
What are the options for me to come back if I wanted to come back after 6 months (i.e sometime in December 2007 or early January 2008)
1. Can I come back on my current H1B visa after getting a visa in passport, if I am not out of status and start the Labor process again.
2. Can I apply for a fresh labor on PERM while working from here and get it cleared and apply for I-140 in premium processing and get all this done before Feb 25, 2008 and enter U.S.
3. Is there any alternate option which I can do with payroll still in US and apply for current H1B extension from Norway?
4. Any other better options.
What are the options for me to come back after one year? My attorney mentioned that I am not in valid status any longer due to the denial of labor by DOL and requested me to be out for 365 days and can enter on L visa. For this I have to change my payroll from US to Norway and the 365 days will count only after I do this payroll change. Is there any other better option.
