Help!!! Inmigration Through Marriage To A Permanent Resident

Please can someone help me with this question!!!! :confused:

I'm in USA as a tourist (it is May 2007). I come from south america. I plan to marry a Permanent Resident who will apply for citizenship in May 2008 and hopefully will become one in October 2008??

1. I want to know if after we get married while he is a PR I should apply for a special visa or for a green card?
2. What happens if I get married when he is a PR? will I be able to work right after that? or how long will I wait for that permission?
3. Can I work from the moment I filed the papers until I get the resident card?
4. Would my work permit be faster if we marry when he is a citizen?

1.- You should come to the US on a K-1 (Fiancee) visa. Not a tourist visa, if your intentions were to marry him. He can file I-129 for the fiancee visa and you will do Consular Processing at your home country. It would take about 6-8 months and you can come and marry him.

2.- He files an I-130 for you and you must wait until the priority date is current. You can not stay and live in the US or work. Only US Citizens can petition for a spouse and immediatly have them file for AOS/EAD.

3.- You can work when you get an EAD (if you apply for one) or when you actually receive the green card and get a social security number. If you go back home and come back with a K-1 Visa you can work right away.

4.- Everything would be "faster" if you marry when he is a citizen. Even though "faster" really means 3-8 months or even more.
