I-751, timeline and questions about visiting India

Hi all,

I am a USC and my spouse and I are getting ready to file for the conditions to be removed on her GC. Her GC expires in September and so we still have a few days to file I-751 but in the meantime I wanted to get some ideas from people who have gone through this.

1. I have copies of joint bank statement and joint tax returns. However this is the extent of what we have together since I was well established before marriage and therefore utility bills, mortgage and other things are on my name only. Is this going to be a problem?

2. The instruction asks for affidavits. Does any of you have any experience with this?

3. Once we fill out the forms, can she leave the country to go visit India? Does she have to be back in any particular time limit?

4. Is it advisable to get an attorney?

5. Should we sent picutres with the application or when we are sent a letter for Interview?

6. How long does it take for the interview call to come?

A1: You send whatever shows comingling of finances. Send insurance policies, medical and dental plan statements, etc. Anything that shows a common address.
A2: Very little weight is given to affidavits. I never bothered with them during my I-751 and I was approved in less than 75 days.
A3: She is free to travel. However if her visit will last beyond the expiry of her GC, she needs to wait for the extension letter before she can return.
A4: I don't see a need for an attorney in a jointly filed I-751.
A5: I did not send any pictures as part of my proof. However, I sent copies of boarding passes showing my wife and I taking holidays/trips together.
A6: Only 10% of jointly filed I-751s result in interviews.

Can we file the forms if the spouse whose GC is expiring is out of the country or do we have to wait for both spouses to be in the country to file the forms?

I-751 is filed by the person whose GC is expiring (not USC). It has to be notraized, so I guess, both spouses need to be present in US at the time of filing (unless you are under military duty or smthng).
 
Where does it say that we have to notorize the I-751 form? I will have to double check the instructions but from what I remember I don't recall seeing that...

And as for sending the forms, my wife won't be back until next month and I don't want to wait and pay the higher fees that go in effect from the 1st. If I send it right now, do you guys think they would reject the form?
