Hi friends,
I need your help in an issue about the birth certificate that has to be submitted along with the I-485 form. My date of birth in passport and other documents is different from my actual date of birth. So the municipal authority in India is refusing to issue a birth certificate based on my birth date in the passport and they will not give a non availability certificate as the birth is recorded there.
My question is if we get another certificate from them stating that my birth certificate cannot be issued to me because my birth is not recorded there on so & so date. as given in my passport......will it be enough? It will have the Municipal officer's signature and seal.I also have two notarized affidavits from parents and close relative. Please help........My PD will be current as of June 1st.
Thanks in advance.

Why don't you just have them issue your birth certificate? Translate it and include a certification of translation signed by any friend of yours who can read the original language, as per regular guidelines. BUT - include an affidavit with your application that your Date of Birth that you have regularly used is not according to your original birth certificate, with reasons for why this is so. If they have a problem with that, then you can worry about it. I'm sure you are not the only case they have seen like that. For example, many people born around Dec 28-Jan 3 register Jan. 1 as their DOB, so it's not that uncommon.

-------------- it has to be same on passport, DL, I-485 form G325 form and Birth certificate. if you knew that problem why you did not change it on your passport? you had enough time having passport with you.

-------it may work
It will have the Municipal officer's signature and seal.
----------------May work and if in Indian language then get it translated in english. Let the Notary translate it and pou his stamp and write True copy, they know how to do it. submit the Copy of letter you get from Municipal officer and Copy of 2notarized affidavits from parents and close relative.

I also have two notarized affidavits from parents and close relative. Please help........My PD will be current as of June 1st.

Date of Birth different in Birth Certificate and Passport

I have this issue and am not sure how to proceed. I appreciate any suggestions/comments.

Date of Birth different in Birth Certificate and Passport

My Date of Birth (DOB) on the School certificates and the Passport is not registered correctly. Its off by tens of months compared to my actual DOB. My birth

is registered in the local government records and only a couple of years ago a Birth Certificate was obtained which is when I found out about the issue. The

reason for this mis match started very early in school ( when no Birth certificate was required) and continued ever since as my official DOB.

Now I am faced with a couple of major choices with I485 and not sure the best way to move forward.

#1. Produce the Birth Certificate which has the mis matching date. I am not sure if USCIS will respond and ask me get my DOB changed in Passport which may

have cascading effect on School Certificates and wherever else its recorded ( including Social Security Administration ). This may also turn out to be a huge

undertaking back in the home country. Based on how they correct the DOB on passport I may need a new Visa as well. I am also not sure how much of it can be

done through home country consulate in the US.

#2. Try to obtain a certificate of Non-Availability for the official ( incorrect ) DOB. I am not sure if I can get one or not as my DOB is recorded.

Also, if #2 is not possible, I may be forced to go with #1.

I am not sure in either case what exactly the affidavits from relatives should state.

Birth Certificate Issue

Hi All,

I have a problem that my birth certificate is not in english and, instead of my name it has written (BOY). Now What I know is that I need to translate that certificate in english and then I need two affidavit saying that birth certificate belongs to me. Can some one please tell me if I can use some standard format for this?

Thanks,

Birth Date

I am facing a similar issue. We requested to search the records for my birth registration. They did find that the registration was indeed done. But the problem is the days are off by a week. Not sure whether they will change the records to match what i have. I am not sure whether i can convince the official to issue a NABC. The register does have my mother's maiden name and my dad's name(only lastname). I dont think they change the official records even if it was wrongly registered. I am still trying to get a NABC issued :(

Kaushik
