Hello guys-

I need some help, and I hope I can get some good advice from you.
I have my Green-Card for more than two years now, and I obtained the residency thru asylum, as a principal asylee.
My boyfriend has a visitor status, and I would like to know if my legal status is going to bring him any benefits if we get married. In other word, as my husband, is he able to get a work permit? Can he become my dependent, or that doesn't apply in this case? Any suggestions are highly appreciated.

Marriage will not help your potential husband. Once you are a US Citizen, then he can get immigration benefits from you.
Right now, you being PR can file a I-131 relarive petition for your husband, HOWEVER, the process will take 5 to 6 years and in the meantime he is not elegible for work permit or legal status in the US.

Your best option would be to wait to be a US citizen in 3 more years and then sponsor him...
 
Is that right? I mean, three years is a long time. He has two bachelor degrees, and I would hate to see him wasting his time in not doing something for himself.
Do you guys know any other ways to keep him legal here?
 
He could actually apply for an asylum if he's been in US for less than a year. It's actually the route that my boyfriend took to be legal to stay in US. He just got his asylum too!
 
Bad Advice

Asylumseeker1, please don't give bad advice to people. How do you know that her husband has a fear for life in his country? Asylum is not a game that everyone can play. Its a very serious matter. Unless someone is afraid that he/she will be persecuted back in their country and has enough proof, they don't qualify for asylum.
Star19, I guess if your husband has two bachelor degress may be he can look into furthering his education and enroll himself in a university. That way he can go to school full-time/part-time and stay legal until you get your citizenship and are able to sponsor him.

Instead of getting two bachelor degrees, It would have been benefial if your friend had Masters degrees; however, if your friend got his/her degrees from the US or any other country whose degrees are accredited in US, I think you should pose your question to the other forums, who know about employment related greencards. I am not familiar, but there are other options even though those options are availible with people with Masters degrees; in some cases bachelor + years experience may put you in line for greencard; try those avenues...this particular forum is all asylum; and if your friend's option to asylum is closed, you should exploit other forums...good luck

Why on earth would you label someone's advice as a bad advice? What makes you think that you are giving a better advice? Do you know how it feels to speak a person like that? It is weird...very..very weird...

if you read Asylumseeker1's post he told him with a certain amount certainty using the word "actually" that the OP's husband would be able to get his asylum. Well, that is not true and very misleading, especially when someone has no fear for life. Why would you advice someone to apply for the asylum?If people start applying for asylum just for the sake of staying in this country and getting the green card that's what makes process harder and harder for the genuine cases.

u said u got your greencard through asylum . and it is already 2rs .get your citizinship and get married . as yuo know 2 yrs for USA is nothing . let him be as he is now .

That was what I was suggesting. In this forum, we don't know more about work related visas; therefore, if you pose your quetion to that forum; that might help...there is a whole forum for work-related visas...and if research on this forum, you will find them..

Ok the way it works is that someone sponsors you for h-1. You can apply for jobs & have the company sponsor you but you cant start working for them until you have a H-1 visa. There is a quota of 65k which is filled in less than 1 month...

If you have a masters degree from U.S college, there are 10k visas for those people but those also go by really fast. The visas for those jobs are for like IT, adversiting etc..

If you are an extraordinary alien like an Actor, Doctor, Lawyer, Executive, you go through a different visa category called EB(extraordinary ability) visa which also has quota but is easier to get.

then there is L1 company transfer visa. If he works for a company in the UK that has offices in the US, he can transfer, granted he is qualified, to the US and there is no quota for that....Thats the loophole that many are using right now..but you have to be really qualified because ofcousre they interview you before issuing you a visa.

Once you are in the states on any of the above visas, you can adjust your status to PR but that takes time(it has limits on # of gc issued).

Or he can come on a student visa and stay here until you become a U.S Citizen.

If he hates U.S, you can go back but travelling on RTD back and forth and being Fingerprinted in the UK is really a hassle in my opinion.

I know that this is an asylum related forum, and I posted my question since I am a green card holder thru asylum. I just wanted to know if I could help him thru my status.
I know about work-visa, but he didn't make the cut this year. There was a random selection since they received around 150,000 files in the first two days, and there is a 65,000 cap. Therefore, I think the best solution is to go to school and wait until next year to apply again.
Anyway, thanks for your advices.
 
Remember F1 is not dual intent. Being a spouse of LPR does not do anything good when it comes to F1, but it could cause F1 visa denial. Better get F1 before marriage.
