Now I hold two approved I140 applications from the same company currently I am working with

I-140/EB3 with PD in 2002 was approved in Apr 2007
I140/EB2-PERM with PD 2006 was approved in Dec 2006

Coz I filed I-140/EB2 first, and got it approved with PD in 2006, can I file I-485 directly with both I-140 attached? I know I need to note this clearly in the cover letter to prevent my case being rejected.

Or do I have to re-file the I140-EB2 to get my PD changed to the old Priority date first, and then file I-485? Is there any form I can use to change the priority date on I-140?

Highly appreciated if any one could kindly answer my question!

------------------ you are eligible for the PD of 2002 and you need to write on cover letter at the time of I-485 filing and provide the evidence of early PD to USCIS.

Thanks a lot for the reply. I sent the whole package out last monday, and my check is cleared today. It looks like my carry-over appplication was accepted by USCIS.

Thanks for sharing the good news.

My filing is exactly the same as yours. Package was delivered to NSC on 4/19, and checks still not cleared as of 4/30. Thanks.

Good luck to you 2!

While I just got an email from my paralegal, TSC rejected my application. The paralegal just mailed the applciation back with a letter to the service director. I hope it works this time. What did your lawyer do specially?

My EB2 I-140 was approved by VSC, the EB3 by TSC. I-485 was mailed to NSC and rejected by TSC. Any comments/suggestions. Thanks.

How did you apply for EB 2 with same company?what was the scenario..experience or education?

Actually I did it all by myself. I quoted the federal rule regarding the pd portibility in the first paragraph of the cover sheet, also highlight my pd and eb2 category. I also put sticker with old pd highlighted on both I-140 approval notices. The package was sent to NSC and got transferred to TSC thereafter. Hope it helps!

eb3 was filed through old labor system : Bachelor degree + 2 years of experience.
eb2 was through PERM: Master degree + 0 year of experience
