ac21 and i-140 approval copy

I am about to start the process of AC21 and am already in (initial) consultation with the immigration lawyer.

I have my job descriptions from ETA 750A and 750B and my next job will be pretty close to these job descriptions - so that part seems to be okay.

But, since I am currently working for a LARGE company, the company lawyer has the i-140 which was approved in early 2005. But, I have never seen the approval copy. Even though I have the receipt number and checked with the USCIS website that it's indeed approved.

My question is:
if I can not get a copy of the i-140 approval from my employer, am I still okay to proceed with the AC21. I have seen some 'AC21 stickies' which show that i-140 approval copy is submitted with AC21 application. Any thoughts?

another questions on i-140 ...

Is there any way to ask for a i-140 copy without raising suspicions?
Or asking for a copy of the i-140 approval will guaranteedly give away that I am considering AC21??


I think if my company attorneys smell that I am considering changing jobs, then they will not give me anything. not even a copy of i-140 approval. I have read somewhere that i-140 is the property of the employer etc.

Also, I am sure they will revoke the i-140 once I quit :( That's why I definitely have to be prepared to pro-actively apply for AC21 or file AC21 as soon as I get a NOID from USCIS when the i-140 is withdrawn.

Any un-suspecting ways of asking for the i-140 copy? :)

I had the same issue. I also worried about what to do. I had already given the 2-weeks notice at the time. A week before leaving, I simply emailed the lawyer (actually her papalegal) and asked for the I-140 approval copy. He emailed me back with the copy in PDF file. He didn't ask why. If he did, I was going to tell him that I was putting together my greencard documents for record, etc. The lawyers didn't know I was leaving then. Do you have I-140 receipt at least? Just ask them innocently. I don't think it will be a problem.

Be careful and good luck. I hope your company doesn't withdraw your I-140.

There's no requirement to provide a copy of the I-140 approval notice when claiming AC21 relief; USCIS knows your I-140 is approved. ;)
 
Thanks for the replies guys. That means then I won't think of any clever ways of getting the copy of i-140 approval as I know for sure it's approved.

(As I posted in another post) Also, from my LC's (subs) it's systems engineer and my approved i-140 is software engineer and they look similar. And the new position is most likely going to be senior software engineer or advanced tech support engineer (I am looking at couple of different jobs :) but they all are related to software+support engineer etc )

Here's my question, I do not have a copy of the original LC on which my subs is based and the i-140 is approved in 2005. But, I do have the 'text' of the job descriptions from both the LC (systems engineer) and the i-140 (software engineer). And as mentioned, the new job will pretty close to these job descriptions. I will try to get a copy of the (subs) LC applciation for the original 'systems engineer' job desc from my current company lawyer but may not get it ...

Is that enough information to proceed w/ AC21?

(I have the usual i-1485 receipts, and other information needed for AC21.)
