Hello Gurus,

My wife attended for H4 visa interview and she received a 221g query.
The query is because of low W-2 wages reported for year 2006. Since i was on bench for initial 2 months,i did not get salary slip for 2 months. My employer has told that he will give me a letter saying that till i recieved a SSN, i was paid in terms in terms of other benefits such as accomodation and a cash advance.
I need your advice on this, would this letter from my employer be sufficient for getting H4 visa for my wife. Has anyone faced or heard of such a situation and what should be the best path i should take.

First find out how much short of your W2 from your prevailing wages.
It is exactly 2 months salary short fall get letter from your company explaining the fact that you do not have SSN and submit it. A carefully written letter with accurate figures will help you to solve the problem.

Thank you great_guru for your reply, here is my detailed case...

Sal in LCA: 46,000 PA
Sal which i am getting now: 60,000 PA

Reported wages in 2006 W2: 4800

Arrival & Working start date as shown to consulate officer: Aug 31 2006

1st Sal Slip for Nov 2006 issued on Dec 15th 2006: Gross $4800 PM
2nd Sal Slip for Dec 2006 issued on Jan 15th 2007: Gross $4800 PM

Since i was getting paid 15 days late, my W2 for 2006 reflects salary only of Nov' 2006.
My payslips in year 2007 reflects in the columns "gross deductions this period" and "gross salary this period" salary which
i received for Dec 2006 on Jan 15th 2007.

What are the various possibilities which i/my employer can look into?

Start date 1 Sep 2006

Since SSN got only in 1Nov 2006, he is in our pay roll only from 1 Nov 2006.
His annual salary per LCA: $$ Monthly Salary per LCA:$$

His current annual Salary : $$ Current monthly salary: $$

Nov Salary:$$ which is x $ more than LCA monthly salary
Dec Salary: $$ which is x $ more than LCA monthly salry

Total.

The issued W2 contains only Nov and Dec 2006 salary only.

The letter from employer must contain min above details.
