Immigration Officer advised not to return within one year?

Hi,

My parents have been visiting us multiple times with their visitor visa. The last time they came, they were told not to return to the US within one year by the immigration officer. Is it one year from the date she entered the US or one year from the date she left the US?

How often and how long were they here.
I would take the warning to mean that they should spend a year in home country.

They are still here in the US. They just got here two weeks ago. The officer did give them 6 months. They've been visiting very often in the last two years because of the two babies we have two years ago. They've been spending 4 or 5 months in the US, then 2 or 3 months home, then come see the babies again. We didn't think it would be an issue until now.

I would like to sponsor them to become PR, but my case has been pending because of the FBI Name Check for two years, and there is nothing much I can do. As far as I know, I can't sponsor them until I become a citizen.
 
Looking at their visitation pattern, I would advise them to consider the officer's warning seriously. They might be turned back from the airport next time. The one year period will start from the time they leave the US.

Based on what law the border officers will issue such warning? So, US is actually driving all the vistors out, right? No wonder why the US visitors drop 30+% in the last 6-7 years.
 
If you spend more time in a country other than your own, you are no longer considered a visitor. You are considered a resident or immigrant. Burden of proof is on the applicant to proof they are not going to be immigrants.
