hey guys, i was wondering ig i am able to go through the dv 2008 program when i have overstayed visa for about 5 years, because of fathers murder in another country. so i applied for the dv 2008, and want to know if anyone out there has done it and suceeded, or if someone knows someone who did it and suceeded. i also finished high school and go to college. so thankyou for your help.
 
we need to know what visa you were on, and how long it has been since you left the States. How old were you when you entered the States and how old were you when you left?

i was on tourist visa. i came here sep 21, 01, and havnt left us since. i was 13, and am 18 now., i didnt leave, was gonna do aos.
 
you can't do AOS since you have no status. As far as I know all illegal presense accumulated prior to your 18th birthday does not count towards the illegal presense punishable by a ban. If it has been more than 180 days since your turned 18, but less than a year - a ban = 3 years. More than a year of illegal presence - equals a 10 year ban. That's if you've won by now and decided to do CP.

In any case, if you are not leaving the US, the only way for you to legalize - through USC spouse or USC parent (until you turn 21).
 
we are in the similar position kahonakaho. i dont know if i want to be picked for the diversity visa 2008 now or not.
