Hi All. I'm a B1/B2 visa holder & have made many trips to the US. I want to spend max time possible wth my boyfriend who is a GC holder. Obviously, its not advisable 2get married as i'll have to wait fr 6yrs or so to get my gc. Thats why i was thinking of either applying fr H1 or F1. I DON'T want to go to a consulate cause there is a risk of my tourist getting cancelled as a potential immigrant.
My question is,
(1)should i declare myself as a prospective student at poe & try fr F1 ? or, should i try fr H1 & apply fr change of status after entering US on tourist?
(2)if h1 or f1 gets denied, will it affect me later when my boyfriend applies fr fiancee' visa fr me at consulate? Will they ask me my paystubs etc or college marksheets?
Where F1 is concerned, i hav been an avg student &am thinking of studying hospitality( i have exp in hospitality industry). As far as H1 is concerned , I have a MA in sociology ( i have studied statistics at masters level), software courses & i have 1.5 yrs exp.
Please help me make the right decision. Thanks.

This year H1 quota is already over, unless you get a job from Non profit organization H1 is ruled out until April 2008. Only posibilities are F1. To change your B1 to F1 you may have to declare @POE

For study first you have to get admission from a school and obtain I -20 before talking ablut F1 As far as H1 is concerned , I have a MA in sociology ( i have studied statistics at masters level), software courses & i have 1.5 yrs exp. For H1 first find a job - your employer willing to sponser you to apply your H1 in April 2008 so that you can start working from Oct 2008.Please help me make the right decision. Thanks.

B1 to H1 Stamping.

I am currently on a B1 Visa and i have an approved H1. Do i have to go back to india to reenter as an H1-B Employee or can i get it stamped here(Canada / Mexico). My H1 is already approved for 2007.

If you have the Approval Notice in hand, see if there is a tear-off portion at the bottom that seems to be an I-94 bearing the same number as the one printed on your I-94 issued last time you entered in the U.S. If you have the replacement I-94 in your Approval Notice, that means you successfully changed your status and you won't have to go for H-1B stamping to work. But you need H-1B stamping one way or the other once you go outside the U.S.
