Transfer 485 NSC-->VSC what does it mean???

Please shed some light on this issue. I would appreciate your feed back.


I filed I-140/485 (EB-2NIW) at VSC in sep. 2005. Got the I-140 approval from VSC.

Last year around July 2006 VSC transferred our 485 file to NSC since then our files are pending.

My EB-1 I-140 got approved at TSC this year.

Last week I sent a fax and letter to VSC about correcting the A# in my I-140 (EB-2NIW) which they did initially (Service center error). In my approved/receipt notices of I-140 my spouse A# is printed. Whenever there is LUD in my approved I-140 (EB-1EA) my spouse 485 case is also getting LUD.

Yesterday I got the following email from USCIS saying that my spouse 485 file has been transferred to VSC again. Do not know the reason why? I am confused. Whether my approved EB-1 is linked with the 485 filed under EB-2NIW or something else is going on?

Your case is much complicated, at least at my level of understanding:
1- You have two approved I-140s and you and your wife applied for AOS.
Q- Do you have two A# from each approval or just one for both?
Q- What exactly wrong with your A# you fixed, are you sure this is a mistake or just another number from double applications?

2- The second approval trigerred all these file transfers.

3- Do not worry about the LUDs, these are internal handling of your case, the important issue you care is the status; pendin, approved, transfered...etc

4- I want you to go with one I-140 approval and ignore the other for the time being not to complicate things more.

Here is the further details

-We filed I-140 and 485 concurrently under EB-2 NIW before retrogression hit in sep. 2005 at VSC. I am the primary and so for my spouse only I-485.

-Got the approval of I-140 (EB-2NIW) on Feb. 28, 2006.

-In July 2006 our I-485 files (mine and my spouse) were transferred to NSC and the online message was saying the following for both

Current Status: This case has been sent for a standard interview.

On July 13, 2006, we transferred this case to our LINCOLN, NE location to conduct the interview that is a standard part of processing this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS. You will be sent a notice when the interview is scheduled, or if the office needs something from you. If you move while this case is pending, call customer service. We process cases in the order we receive them. You can use our processing dates to estimate when this case will be done. This case has been sent to our LINCOLN, NE location. -I filed EB-1a I-140 at TSC on Jan 12, 2007 and got the approval on Feb. 26, 2007.

So now I have two I-140 approval (one from EB-2 & EB-1) and only one I-485

A# in my I-140s : X (alien number of my spouse)
A# in my I-485 : Y

A# in my spouse I-485: X

VSC initially messed up BY GIVING A# OF MY SPOUSE in my I-140 (EB-2NIW) and it carried over to my approved I-140 (EB-1a) too.

Because of this (I think) after I got the approval from TSC (EB-1 I-140) my spouse I-485 online status changed to the following

Application Type: I485 , APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS

Current Status: This case is now pending at the office to which it was transferred.

I wrote to TSC about the error by sending the supporting documents (my receipt notice/approval notice obtained from TSC and my I-485 receipt notice which I got from VSC in 2005). TSC corrected the error in EB-1a I-140 and sent me the AMENDED APPROVAL NOTICE. I also sent the same request to VSC on March 13, 2007 and it was delivered on 14 March 2007.

On the same day (March 14, 2007) the online message of my spouse I-485 changed to the following

Application Type: I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS

Current Status: This case has been sent to another office for processing.

Nothing happened to my I-485. Probably you would have got the whole scenario. Sorry for the long posting.

The whole process correcting A# I am doing because I can take advantage of Priority Date which sep. 2005.

I think now this mistake with your A# will trigger a lot of problems unless you fix it completely. From my experience with the system here, it is not one letter or two will fix it. You need to follow with them and keep sending and calling to fix it, because they will fix it in one place not the other (you can even take an Infopass to talk with officer to discuss it with him and be sure that every thing is fixed). When your security background will come, it will come with any of those A#s, because the USCIS will be lazy to send this correction to the FBI. Every time you send an inquiry, let them know that change and attach the amended letter with any package. Be sure that your I-485 is now connected with your EB1 not EB2 as you already filled. You have to have a confirmation about that to take the advantage of PD. Ask if you can file another I485s with the EB1 approval or not to make it easy. Keep the I-140 EB2 dormant in case you may need it if any thing happen to your other I140.

Thanks mmed for going over my stuffs and giving your suggestions. Filing another 485 is always possible BUT you loose PD and the NC will start all over again. I am expecting the transfer notice from NSC and it should come by this week since it was sent on March 14, 2007. After seeing the content of the transfer notice I will take further action. Today again I sent a FAX and Express mail to VSC stating the problem of A# in my approved I-140 EB-2 NIW.

By the way when we filed for advance parole and EAD last year around August 2006 at NSC our AP applications were transferred to VSC and the transfer notice said that to speed up the processing they have transferred to VSC. Finally we got our AP from VSC but EAD is from NSC. If there is discrepency in my A# how come NSC and VSC approved my EAD and AP. Shed some light on this.
 
I think you are in good shape now. What I am saying is to take care and do not say I fixed every thing and forget it. The USCIS needs folow up and multiple reminders and that is it. Good luck

Hi mmed,

do you think I should take any other action other than calling customer service and asking them to connect me to an immigration officer at VSC and explain to him what is going on again (I did last year after our 485 files were transferred from VSC to NSC). Any other suggestion do you think of?

ONe more thing is when I got the transfer notice of I-485 for me and my spouse from VSC last year (July, 2006) the notice said that "Preliminary processing of the above application has been completed, and it has been transferred to the INS office at Nebraska Service Center, P.O. Box 82521, Lincoln, NE 68501-2521. That office will notify you when they schedule an interview on th eapplication or petition". Does it mean our security check/back ground/NC or whatever check you may call is over? what we can make out of this.

Thank you mmed. How to know whether my NC is over or not in that case? How to start the process of knowing whether i am stuck with NC/security check?

Today I received the transfer notice my spouse's 485 file from NSC which says the following

"This is to advise you that in order to speed up processing we have transferred the above case to the following USCIS office for processing,
Vermont Service Center, 75 Lower Weldon Street, Saint Albans, VT 05479

That office will notify you of the decision made on the application or petition.
Please refer to the folliwng information before attempting to contact the National Customer.... bla.....

Does it mean anything? because same kind of transfer notice we got when NSC transferred our AP application to VSC (to speed up processing..). Ultimately we got our AP from VSC after about couple of months.

Any comments....?
 
That is fine, this is just a form printed to every one and does not mean anything. Be sure that the A# is correct.

There is no problem with my spouse A#. Has anybody got these kind of message in their transfer notice (especially 485/131/765). When our 485 file was transferred from VSC to NSC this message was not there. I will wait till next week if I do not get any response from VSC regarding A# correction in my I-140 I have to again send FAX and Express mail. Getting tired with these guys...
