Lottery vs. F1

Dear friends,

I am one of DV-2007 winners. My interview will be in June (or July). Recently, I managed to receive an admission from a prestigious universities in the US and I should start my studies there in August.

My question in about the appropriate choice in getting US visa. I think I cannot wait for DV visa because I am from a middle-eastern country and my background check might take a long time (I hope it will be ready by Sep. 30). On the other hand, I heard that if someone has an immigrant case and apply for a non-immigrant visa (student visa), it is highly likely that he/she will be rejected. Did you hear about this issue? What should I do to get the US visa in a short and safe way?

Any help is very appreciated.

yes, since you already mailed your DS-230 form, you showed immigrant intent, and getting any non-immigrant visa would be extremely difficult. Your best bet is to try to get your DV visa. If you don't succeed, then you can try for F-1. Whether you try to get F-1 before or after DV visa doesn't matter all that much.

I am wondering how good this idea is to ask about my chances of getting F1 from the US embassy where I have an open DV case. Will the question be helpful for me or it might have negative effects?

I would say that go for your F1 first and don't tell them that you have DV in your future. If they don't check you, probabley they won't understand it.

If you tell them that you have DV case, you are DEFINITELY rejected. That is law. If you don't, they may give you visa.

Worst case, you don't tell them, and they will find out themselves. Then, they won't give you F1, but you will go back to embassy for DV. You won't lose anything.

All in all, I think your chances for F1 is not very high because of your DV case, but its a risk that you might want to take.
 
divaneh, he can't say that he doesn't have DV interview in his future. Since he filed form DS-230, the question on the non-immigrant visa applications on whether he ever applied for a GC needs to be answered as "yes". Otherwise, he will be barred from the US forever for giving false information to the consular officer. He will lose everything in this case. Do not advise people to lie to the consular officers. If they follow your advise, they will pay dearly for it.

My dad put in the applications that he HAS NOT gone to the military service ever (false information), and when the consular asked the same question, he said that yes he has.
Nobody barred him from US?!!!

Pls forget about my comment and your F1, because legally you cann't get it till Sep 30th, and after that it will of no use to you.

Thanks for your comments. I asked the question from an immigration lawyer and he told me that although I can apply for the F1, I will likely be rejected. I decided to send an email asking the question from the embassy as well. If their answer were the same, I'll defer my admission and wait for my DV visa.

pls write the school that gave you admission and explain the situation to them, so that they can defer your admission till next year,

not in the first year - non-resident state fees apply in most states in the first year. When you actually get your GC, make sure you are not studying full-time in the first year of college (if non-resident tuition applies), because in this case you will still be considered non-resident in your second year. Do find out the details at your Financial Aid office and registrar's office when you arrive.
 
I have two questions regarding the tuition fee waiver.

The state of my permanent address which I wrote in DS-230 form (item#10) is different from that of the university from which I got admission. To be able to use the resident waiver, when should I change my address (during interview, or at POE, or ...)?

What if I decide to change my university to another state after entering to the US? How can I use the waiver in this situation? I mean, how should I change my resident state if I move to another state?

your DS-230 has nothing to do with your tuition waiver or in-state tuition. Tuition waiver in general is not the same as in-state tuition. If you got a tuition waiver from the school - that's great and you won't have to worry about paying out-of-state fees.

You become a state resident when you get a State ID (State ID or driver's license) in that state. IF you move to another state, you start from scratch.

what if I applied just for the lottery without filling DS-230? is it going to against me to renew my F1-Visa?

They sent lots of emails to subscribe with them and I did, but now I just realized that I'm in big trouble to go back home and renew my visa!

If you did not win the lottery then you don't even need to worry about problems with F-1 visa renewal.
For the records, if you did not submit DS forms to KCC, then you have not demonstrated immigrant intent and you should not have problems renewing your visa

Weeks ago, I just came from a vacation I had it at home. The INS at Dulles Airport in Washington DC asked me some question about if I have been submitted for a green card. I told them that I have been submitted for a lottery program but I canceled the procedure since I knew about the regulation of being a student in the United States!

Any bad expecting about this issue because I am worry that they will prevent me to get in the USA again next vacation. It is really my high priority to be OK with these people so I will have done my plans to be graduate from the USA!

I know that I was annoying you guys, but you are the people how can make myself comfortable!

Don't worry. If there was going to be any problem they would have sent you back to your country immedietely from the Dulles airport. If they let you in, you are in good shape.
 
applying for DV lottery is not the same as applying for a GC. Now, when you win the DV lottery and send forms DSP-122 and DS-230 - that's the application for a GC.
