Please only post approval and other news like reciept of 'responses to enquiries' sent to the Dallas BEC after 90 days of the 45 day letter.

Just some basic stats...no other news
Dallas PD processing is pretty much moved into 5/01 (finally). Also RIR queue is now over 16,000 cases awaiting RIR analysis and around 1800 (RIR and TR) awaiting final CO review for approval.

(Remember that many many cases between 5/2001 and 5/2002 PD has already been processed by DOLS, I have excluded the cases processed by CA DOL, but I dont have an exact Idea enough to remove cases from other DOLs)
SO WORST CASE SCENARIO WE HAVE 4511 Cases before the RIR Queue reaches May 2002. i.e. 4511/90*2 (90 cases a day per BEC)= 25.06 Days ~ 1.2 month.

My estimates are that there are very few cases between these dates actually and we should get May 2002 cases in Analysis within a week or 2 at max..

ICARUS...Please just send us a message once you see even 1 (ONE) May 2002 case in Analysis (PLEASE)!!

I had sent a status inquiry email to the Dallas BEC on April 04, 2005 for my case. My priority Date is January 30, 2002. RIR/EB3 from Oklahoma.

Here is the response that I got today (May 02, 2005):

Dear Requestor:
The purpose of this letter is to acknowledge your request regarding the status of the above-referenced case.

The new case number is: D-04264-XXXXX

The above-referenced case was transferred to one of the Division of Foreign Labor Certification’s Backlog Processing Centers. At this time, the case is in final review.

DOES IT MEAN ANYTHING? HAS ANYONE ELSE GOT THIS KIND OF RESPONSE? SHOULD I SEE THIS AS A POSITIVE SIGN?

As per what I infer from this, as of 2nd May 2005 Cases with PD January 30 2002 had already been analyzed and sent to the CO for final review and approval...

This is in line with my analysis and Icarus's invaluable news..

So we can maybe assume that the queue is as below

As I have said before..the number of cases pending between April 2001 and May 2002 is much less than in this analysis suggests as these cases were processed by various regional DOLs over the past months..

Just to update the tracker, I heard a friend of mine, whose PD is May 2001 SF RIR, received 45 days letter yesterday. He made several inquires to D-BEC, and before getting any respone in email, he was glad that he received 45 days letter. His name is Subramanyam Sankatacharya, we call him Swami.

PS: ZB, if you are not satisfied with my input, let me know and I will delete my entry from this post forum, where it seems like you have FIVE posts in a row.

Thanks for the information. Can you clarify wether this is a Regional case or a State case? If it is regional case this is an anamoly as he should have got his 45 day letter somewhere in Jan-Feb

Indira Gandhi, you don't have to be so sarcastic - what ZB is doing is good - the Philly BEC tracker has become more of a online petition against USCIS - Dallas BEC was not sticking to the main point..so whats wrong in ZB posting 5 messages in a row? he is giving the background behind this thread..keep your hatred against him to urself

Just got off the phone with Swami, and he mentioned that his case is the Remanded Regional Case. He refused to provide further information as his ability in looking 45 days letter is limited since the letter only been delievered to his attorney office, who presently runs the firm in East Coast. Swami further mentioned that after filing his LC, he moved from his old address, and its a good start for those who are waiting on 45 days letter may wanted to update with USPS as the letter is intended to send for both parties, lawyer and the petitioner.

Since you have done an extensive analysis, I would like to know where RIR->NON-RIR cases : PDs between Aprl 01 to Sept 01 fit into this? There are many such cases from CA SWA which got transferred to BPC.

Will they be treated as RIR or NON-RIR in BPC?

What if a case qualifies for RIR as per the 2002 DOL guidance BS + 3 yrs or MS + 6 months ? Does this guidance come into picture @ BPC ?

Any valuable inputs on this would be helpful.

What do you think experts ? Should I go for PERM or not ? I am totally fustrated & loosing bunch of good offers every year waiting for this stupid LC. Could have trippled my salary by now. My employer / attorney asking me to conver to PERM but I am not so sure. What say you ?
 
I am in the same boat. With all the offers that I have declined over past 1 year I could have literally doubled my salary. I think we should potentially file a lawsuit against DOL that is stopping people's career growth and equal opportunity. Its like throwing immigrants in the job market and then not letting them grow in career in terms of position and salary. I hope some lawyer can take my case.

All remand to state cases from CA were put into the NON-RIR SWA Queue..

So unfortunately the misery for the remanded to state guys continues..

what is ur position and major? how many yrs have u been working for this company? how many yrs of experience u had before joining this company?

my opinion is to hold on PERM now because there was no single approval yet and nobody know show things will go like the buisness necessity to wages to auditing. my advice is to wait few months.

You have a PD of Apr 2002...RIR-EB2...NO-WAY (as per my opinion) should you convert to PERM now and take the risk of throwing away your PD.. in case of a rejection.

Your case should be in analysis right now according to me.. You should see an approval notice any day. I suggest you send a formal enquiry for status to the BEC immediately.


And by the way, I would have had my own company by now, if I had my GC. I had VCs ready to finance me, but I would only get 5% stake in my own idea because of the H1B status.. so I declined..The pain is really unbearable but what to do..

I am holding Senior Manager position in a Fortune 50 company (Field of Telecom). I rejected many position of Director or VP level waiting for LC.. My company trys to convince me by give 10 to 20% every time I get an offer But its not enough man.. Thats what they are not telling me to go for PERM.. So you think I should hold for some time, or atleast get the advertisement and other parts done for just in case ?

Hey, you can have your own company with H1B.. I do own 70% stocks of a small software development firm in bay area/pune.. with about 20 people working in US / 70 in India.
