    TSC Consolidated 485 Tracker

Approved! I got great news from TSC this morning - my GC is approved. :D I am happy but still in shock! This is my third attempt after living here for 8 years on H1. No LUD on my wife's GC but I'm sure it will be approved soon. As much as I resent the USCIS for years of delays, TSC has really...

    Social security taxes

Wrong. By the time you retire (I assume you aren't 50 yet), there will be no money left in the US social security system. You will get them same thing all people currently paying into the system under 50 will get - probably nothing.

    H1 approval taking too long

No - all the H1B dates are in August. I don't know where you got November 5 from? My July 16 extension is still pending.

    H1 and H4 visa extension

I am not an attorney, but personally I wouldn't risk trying to get your wife in with only a few days left on the visa. File for premium processing ASAP.

    Social security taxes

You are ignoring two important facts about the US social security system. Current SS payments made by workers are mostly paid out to retirees within a few years. There is no big pot of money that these payments are going into where they can be paid back to you. The Social Security surplus is...

    H1 and H4 visa extension

I have been waiting six months for my extension, filed in July. If I was you I would pay for premium processing, or change your travel plans. However, you can keep working and your wife can remain in the US while the extension is being processed, beyond Feb 05. It's not clear from your...

    H1 approval taking too long

Nebraska is still processing August and they won't get to your H1 for at least a month. I've been waiting over six months for mine. Pay for premium processing if you need it faster.

    Social security taxes

With all due respect, you are wasting your time if you think (a) there is a way for H1's to escape Social Security taxes (b) there will be any Social Security left for anyone currently under 40 and (c) the US is going to sign a social security totalization agreement with India. Claiming H1's...

is spouse name in passport a MUST for H4?

I've never heard of such a thing. If you need proof you are married, carry your marriage certificate. My wife doesn't have my name in her passport and she has an H4.

    H1 and H4 visa extension

I am in the same situation - applied H1 extension July 16th thru Nebraska service center. The USCIS processing time report of Dec 17th claims Nebraska are processing July 30th. In the next two weeks or so USCIS will put out a new report. If the processing date moves 30 days past your...

    PERM and RIR in parallel?

Except the DOL is taking multiple years to process LC's, so an employer could offer two different positions over the time frame involved.

    PERM and RIR in parallel?

Sure - as long as the new LC filing is for a different position (which in the case discussed in this thread it appears to be because it has different requirements and salary)

URGENT--Please let me know the answer for this question

    1. No. The six year limit is for all time spent on H, so you cannot transfer to H4. 2. No, otherwise everyone would do this! I would seek a good attorney. Maybe you could transfer to a student visa or something?

PERM and Pending Non RIR LC???

Nobody knows yet. You need to wait a week or two for the attorneys to get back from vacation and post some analysis of PERM.

    Analysis of final PERM regulations

Your attorney called me and told me they found an excellent US citizen employee for your position. Apparently he knows how to post on a message board in the appropriate area so they hired him instead.

    Analysis of final PERM regulations

You are right that the official DOL policy says you cannot have more than one labor certification for one job. But in the case described above, if the job has changed in the years since you filed the first LC, then we are proabably talking about an LC for a different job. In my case I plan to do...

    Analysis of final PERM regulations

Yes, I believe they can. I think this is the safest course of action for many people. Preserving the priority date is only an issue for those people concerned about the caps for India, China and the Phillipines. For the rest of us I don't think it makes a difference.

    Analysis of final PERM regulations

Keep reading: (4)If the job involved in the application requires experience and an advanced degree, and a professional journal normally would be used to advertise the job opportunity, the employer may, in lieu of one of the Sunday advertisements, place an advertisement in the...

    Analysis of final PERM regulations

I agree that this is a lot better than it could have been. Because they allow experience in different jobs, this is good for H1's who have been with an employer and got promoted over time to new jobs, as they can count some of their experience. The restrictions against contract workers...

Here is my hot water story

Consult a good immigration attorney and I am sure they can create a job spec that requires a college degree and describes the work you will be doing. Joe, we've discussed this topic many times before and disagreed. As I have pointed out, there are thousands of H1's in executive management...
