It appears that as long as you have worked unauthorized less than 180 accumulated days since you last entered the US. you can keep working. I guess you need to track the days of unauthorized employment carefully to ensure you don't reach that magical number of 180.
The USCIS will let you know if you have to go to another inteview. I doubt they will do such again. More likely, you now just have to wait for your case to end up on the top of a pile to be finally processed.
I believe you can work unauthorized for up to 180 dayes and be forgiven by the USCIS. In that case, you should be fine. Try to get the interim and do the regular filing ASAP, though. There are people on this forum like "The Real Canadian" who know a great deal about the legal aspects of this...
The I-485 LUDs can also be that your name cleared the FBI name check. Do this, call the USCIS 1800 number and ask if your names are cleared yet. If the answer is yes, ask what date. If those dates are the same as the LUDs, then you defitnitely know what the LUDs are for. I am pretty sure that an...
I would probably wait 2 more months to give them a chance to clear out (approve) the cases with May and June PDs. My guess is that all you will be told when calling is that your case is being processed and to wait for the notification.
Good point. It may already be approved and your lawyer is the problem, not the USCIS. Do you have the receipt number so you can check online if it is indeed approved? In other words, is the problem that AP is still not approved as verified by the USCIS throught the receipt number?, or is the...
Speculation: The LUD may be an internal transfer of the case or that the name check was cleared. Or something completely else. LUDs are really hard to speculate about.
Strange. The derivative received the AP but not the primary applicant. Also, you seem to have applied 3.5 months ago, so timewise the AP approval should have come already. Try calling USCIS first. If that does not lead anywhere, schedule Infopass appointment and meet with a USCIS rep. in person.
I understand your situation and that you may be forced to travel. My personal opinion, though, is that it's never adviseable to lie to the government, whether it's at a POE, IRS, USCIS, etc. Knowingly lying to the government tends to have pretty severe penalties. I would guess that this also...
The I-140 approvals are very strange. Some apparently take 9 months, while mine only took 2 days - yes it's true - and was approved 5 months earlier than the processing dates published on the USCIS website. I am not sure that there is any logic behind why some take 9 months and others only a...
If possible, perhaps you should not travel at all until GC is approved. By not traveling, you are avoiding the entire issue, if this indeed is possible for you
People on this forum have systematically reported such timeline, and my experience also supports this - 2-3 days for the FPs to clear with status change and 10 days for name check clearance days (assuming no "hits"). I have also found information on the web to support it. Just google the topics...
Name check cleared. That's great news. If the FBI sent back the FP to the USCIS, it should only take 2-3 days before the USCIS updates your status. If it's more then, let's say, one week, there may be a problem at the USCIS end. In that case, call the USCIS and check. If they have no clue...
If you get LUDs on a daily basis for months, there is definitely a computer glitch going on. If you have LUDs 4-5 days in a row, you are very close to being approved. More then 5 LUDs in a row is likely computer problem. I have noticed that 3-5 back-to-back LUDs are normal prior to approval.
You can have multiple LUDs several days in a row without the actual message changing the LUD changes, but the message remains the same. This is very common and good news. Your case is currently processed.
Strange... LUDs and even status updates should have appeared by now, especially since the FP is already done, and perhaps an LUD for the name check... I hav no answer, but admit it's strange.

I only mean FPs. The name check is a completely different beast. FPs go really fast for eveyone. Name check can go very fast or extremnely low, depending on if your name gets any hits.

That's it: name check, fingerprints, and biometrics. No more.
