I am skeptical about whether they are even following their own rules. A friend's non-concurrent 485 filed in May 2003 was approved last week. His 140 was approved in 2001. Go figure. Policy my @ss.

Thanks all. Also got another email 1/2 hour later with an approval on my EAD of ND 9/04. I thought they may deny the EAD since 485 is approved, but I guess one never knows how TSC works ! It pours when you don't expect I guess :rolleyes:

Did some scanning for Jun 2003 cases. There are many many approvals in this range approved in Aug. 04 and Sept. 04. No wonder 2002 guys are getting screwed. Most resources are for 2003/2004 guys. Fairness gone with the wind. :mad:

While we are on the fee subject, for those defending TSC, my question is if 485 is pending beyond the processing dates and you have not got an RFE why should the filer not be entitled to a refund on 485 fees ? Also, why should cases not touched but waiting longer not be refunded 485 fees ...
