Hi,

I'm currently have to make a choice in the next few days and would very much appreciate your inputs/opinions.

I am WAC-02145* EB3 with RD of 03/26/02. Am on my 2nd EAD, 2nd FP completed in Feb 04. My case has been touched 05/07 and again on 05/11. My wife's case touched 05/07, 05/11 and again on 05/17.

I am still with the petioning company but have recently been asked by one of the hottest company's in tech to join them but unsure what to do at this juncture. My 485 feels so near and yet so far. The offer is valid for 5 days which means I have to come up with a decision by next Tues.

Please provide any inputs.

go for it....is the wage similar?...use AC21

one thing....never assume you are close.....i have been doing that for over 2 years (my name!) what a mistake that assumption is. You might get approved the next month, it might be next year. I left my old job in Oct last year when I thought I would get approved within the next month or two....here we are almost June and no approval....I am glad I didn't put my life on hold
 
If you don't change job now before approval you will be stuck with your petitioner for at least another a half year after approval because you must show the intention to work for it indefinitely.

[ never assume you are close ] -- sad but true, i assumed this a year ago which is what got me into this mess in the first place.

[ is the wage similar?...use AC21 ] -- wage is 5k less w/ base salary but more bonuses and stock options. will that cause a problem? are they strict with what is stated in lc?

Is the recommended six-month period after gc approval, does that hold true to the current employer also or just to the petitioning employer? I mean, if I work at least 6 mo for my <new> employer even though he was not the one to petion for me, does that still show uscis that i fulfilled my end of the bargain? I thought it was just to the petioning employer.

For almost a year I kept telling myself that I should wait for GC to come.
Everything hinged on it. Then I got tired. I said to hell with that. I think
it makes sense when you just say..."It will come when it will come" and move
on with your life.

So finally after a year we bought ourselves a laz-a-boy sofa, luxury car and
whatever I can think of. GC is irrelevant. I got myself a new mini ipod too. :D

One year have passed since that time. I have enjoyed my luxury car and
I just love the reclining sofa and everything else I bought since then.

Just enjoy life while you can. GC is just one more tick mark. It will come
when it will come.
 
Desi-bartender, that's so damn similar to me. Been dying for an audi but sticking to my old civic. Been wanting a lazy boy but settled for bean bags (kmart no less). And been stuck in same old job for 5 years. And haven't been on a vacation (that lasted more than 1 day) since then.

Still I think we've still been lucky. People in this forum have been putting up with more - like been unable to move, putting up with low salaries, long hours and abusive bosses.

I like your approach. I need more psychological work to pursue it though.

Employment-based GC process is about the future "after approval time" employment in despite of you might be employed all the long time before approval. AC21 gives you the right to replace the original sponsor but it doesn't give you the right to give up the intention to work indefinitely for the sponsor, not necessarily original.
Shortly: sponsor replaced, intention must remain.

Couldn't more agree with you. We've been doing the same. Have been without a dining table or a sofa all these three years that the GC has been going on. ( have been pretending that once we get through this process , we are going to buy a HOUSE and then MOVING with all this stuff would be SO DIFFICULT ) . Realised a month back that fooling ourselves for all of the prime time of life doesn't help. Went out and brought a car with everything and just thinking of getting a vacation to Europe. It feels so good.. not caring about what happens to that application out there..a big burden off of the breaking back...
