RD : august 8, 2002
FP : Jan 29, 2003 ( Expired on April 29, 2004)
RFE : April 9, 2004
RFE Received by USCIS : April 28, 2004

When should i expect my case to be processed?

What was the RFE about. If you are with the original employer you case should be approved in a few weeks after they received the RFE.

Rfe was about employment letter and proof of birth and
parentage. I am still with the same employer. But, my
fingerprinting has expired. I was wondering if there is someone
whose fp expired after USCIS received RFE reply . What is
the status of your case ????
 
I believe FP and RFE are handled by separate people/channel.
I doubt they will approve with an expired FP.

Is there any particular reason why they will approve immediately (after the RFE is received) if you're with the "original employer" ?

From what I understand all they care about is, at the time when the RFE is sent, you should be able to back it up with a letter from your current employer(if AC21 is invoked) or original employer, provided the job title, duties and salary remains the same as approved in your Labor and 140. Correct me if I am wrong.

Original or New Employer - makes no difference. As long you have a job and an offer of continuation on permanent basis, You are OK

Here are my case details ..

RD: 9/2002
1st FP : 12/2002
RFE : 4/13/2004
RFE Replied : 4/26/2004
Received by the INS and online status updated : 4/28/2004

I received my 2nd FP notice on Sat. 5/1/2004.

You should hear form the USCIS (either a FP notice or your approval) pretty soon !!

I have observed that AC21 cases takes longer after the response to RFE has been received than people who have not changed employers.
They might have to check the authenticity of the new offer. If you are with the original employer, the I-140 approval is good enough.
 
Hi maverick, my RD is same as yours. What was your RFE about ? I am bit worried since i dont have good relations with the lawyer and have not filed paperwork for change of lawyer.

Did you get any info from them directly ? I mean in addition to your lawyer. Also, am changing my emp for the second time and not sure how to play this one. My new emp (not yet joined) is in a different service center !
